The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hello! I have the following concern:
    I am from South America. My tourist visa expire 1st February 2021. I just want to stay in Turkey 2 month more because I have a rental contract (if I cancel the contract before time I wont receive the deposite back). I dont want to apply for a tourist residence permit 1 year lenght because I dont want to pay 200 euros en total for only 2 month more here.
    I read about fines in this website, first month is $25 fine + remaining months $5. Or how should I calculate the fine?
    So tecnically is convenient, in my case, overstay and when I leave pay the fine, right?
    And another thing: lets say a policeman ask me for my passport on the street and he/she see I am overstaying. Can I face deportation in that case? Or the same solution: will I pay the fine when I leave?
    I await for an answer. Thanks a lot.

If you applied for a residence permit but because of COVID it’s taking 3 months to process and you have to travel quickly for 3 weeks outside of Turkey before coming back, does that (leaving turkey temporarily) cancel your residence permit ? I know I will pay a fine and that’s ok, but does leaving harm the residence permit process?

  3. my wife has a thai passport and I have an american passport but we would like to visit for 90 days. can she get a 90 day visa or extension to her visa exempt entry? or if we had no plans on returning would it be easiest to just have her overstay and just pay the fine when we leave?

  5. I’m visiting Turkey with a visa exemption for 90 days. I have already applied for a residence permit but the earliest appointment I could get was 1.5 months AFTER my 90-day exemption ends.

    What happens if I stay in the country during that period? Will there be any repercussions regarding my residence permit application when they see that I have overstayed my visa?

    It’s practically impossible to get an appointment within the 90-day period when the earliest appointments available are 2.5-3 months after filling out the online application form. I appreciate your advice here.

    Firstly, thank you for making all this information available — it’s really helpful.

    My wife and I arrived in Turkey on tourist visas in March and applied for Short Term Touristic Ikamets. Because of extended processing times due to COVID, our Visas are now 3 months expired, and we’ve just learned we will need to provide a notarised rental agreement for 12 months in order to get our Ikamet approved. (We inculded a letter from our AirBNB host in our application, but they have told us it is not enough.)

    We do not want to get a rental agreement, as the whole point of us being here was to travel around the country… so now we think we would prefer to leave Turkey and come back next year on another tourist visa for further travel.

    So this is my question — If we do not submit the lease agreement in the 30 day period they’ve given us to supply the additional documents, will our application be automatically rejected, and does that mean we will receive a 10 day grace-period to leave turkey without overstay fines or penalties?

      If you do not provide required documents to Immigration Office within 30 days your application will be cancelled. Although you submitted residence permit application, if you leave Turkey before receiving residence permit card or the application will be cancelled/rejected you need to pay a fine for overstaying. Once the penalty will be paid while leaving Turkey you should not be banned to reenter the coutry. Otherwise the entry ban for up to five years can be issued.

      1. Hello, hope you are fine some of us we apply for the resident permit but with all the documents but we were denied permits and we did it in time and some of the people we were presentation were so insultive and some of as it’s one first time to travel

  7. Hi,
    I overstayed one turkey during Covid 19 and re-entered again snd was given 10 days to apply for residence permit. I applied but still on exit from Turkey I was handed told to 460tl in admin fines.

    I stupidly followed another person in front of me who said he didn’t have the cash on him and was told that he could pay when he returns after 3 months.

    So I also said I don’t have cash on me. They handed me with a paper banning me from entering turkey for 3 months… until 2nd Nov 2020!

    Now what happens when I re-enter? The paper I was handed does not mention anything about payment of fine but stipulates that “all provisions in respect to preliminary permission decision stemming from non payment of admin fine are reserved irrespective of the expiration of the entry ban.

    Please kindly advise, if it would still possible to make the payment may be through a friend at the airport or at Turkish consulate generals?

    1. Hello,
      If there is any valid reason for you to reenter Turkey before end of the entry ban, you should contact Turkish consulate in your home country in order to receive information if you can obtain a visa to enter Turkey. However if you applied for residence permit and did not receive residence permit card before leaving Turkey your application should be cancelled and you can not apply for the same type of permit within 6 months upon the cancellation.

  8. İ have been in since February 2014 without resident permit and l want leave the country by November 2020, how much will i pay for over stay? Also can I pay the money in my country before applying for visa to come back to Turkey?

    1. Hello,
      Amount of fine for overstaying depends on your nationality and will be calculated by the customs at the boarder while leaving Turkey. If for any reason you refuse or can not pay the fine you will be banned to reenter Turkey for up to five years. Fine can be only paid on the boarder while leaving the country.

  9. Hello,
    I applied for short term residency in April with the reason for Turkish learning. But it has been rejected because I didn’t enter the country with a langue learning visa. Now I have to leave within 10 days, but I also received a job offer. Is it for sure that I will be banned for three months? If I get a work visa, can I come back even if I was banned?

      If the fine for overstaying applies to your case and you pay the fine you should not be banned to reenter Turkey. In this case, after you leave Turkey your future employer must apply for your work permit and you will need to submit required documents in Turkish Consulate in your home country. Once the application is approved you will receive work visa in the consulate so you will be allowed to enter Turkey on this basis.

  10. Hello, I’m from Colombia. For the moment I can not fly back to Colombia because the airport is closed probably until November. I applied for renewal in March and I just got a message saying “Sonuçlandırıldı. İl Göç İdaresi Müdürlüğüne müracaat edilmesi gerekmektedir”. I’m afraid the permit was rejected. In this case, can I exit Turkey within 10 days, come back as a tourist and stay for 3 months more? Or if I choose to overstay until the airport opens in Colombia, will I be fined and not allowed to enter?

      According to announcement of Directorate of Migration published on 15.06.2020, foreigners who overstay in Turkey due to Covid-19 should not be fined under condition that they leave Turkey within 30 days from the date since transportation to their home country is possible.       You should also confirm your status with Directorate of Migration.
      If your application has been rejected and you leave Turkey you should stay abroad for at least three months before reentering Turkey.
