The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    Im an afghan student in turkey. I left turkey on 1st of July and came to Afghanistan. Now i cant go back to turkey because the flights from afghanistan to turkey is canceled till 5 September. The problem is my turkish residence permit will be expired on 25th of august and I cannot extend the residence permit from here. Now I have no idea how am i gonna go back to turkey with an expired residence permit. Do i have to issue for a visa to enter turkey?

    1. Hello,
      If you meet the criteria for extension of residence permit and will not be able to reenter Turkey before expiration of your current permit, you will need to submit new application once you enter the country. In this case you will need to obtain visa to reenter Turkey. Please, be informed that if you are currently holder of touristic residence permit you can not reapply for the same kind of permit unless the purpose of stay is other than tourism. Touristic residence permit can be obtained for up to one year only once within every two years.

      1. Please I applied to residence permit in burdur and the Goc idaresi office ask me to provide letter from my school. I got admitted into Tomer. But the school said I have to wait for other students before I could be able to register and get my students certificate. My visa is about to expire and till now I haven’t gotten my students certificate.

  2. Hello. I was renewing my childs residency permit and it was denied because my name is not on her birth certificate. They asked for proof that she is my child and now I have to go london in order to sort this matter out. Is she considered to have overstayed her visa? It expired on july 07th but we made a proper ikamet appointment and then was denied.

      Once the residence permit application is denied, time spent in Turkey after expiration of visa/previous residence permit is taken under consideratin as the period of overstaying. Currently foreigners, who leave Turkey within 30 days from date when flights to their home country are possible do not have to pay the fine. Please, be informed that the final decision on the amount of fine if applies will be taken by the customs at the airport.

  3. Hello I am a bulgarian citizen and I overstayed for 3 months. How much is the fee I would have to pay on the borders and will I be banned for entering Turkey ?

      Official amount of fee applying to Bulgarian citizens for overstaying in Turkey for three months is 70 USD. Please, be informed that final decision on the amount of fine will be taken by customs at the airport and it can differ from official amounts. Foreigners who pay the fine for overstaying if applies should not be banned to reenter Turkey. However, currently foreigners who overstayed in Turkey due to Covid-19 do not have to pay the fine under condition that they leave Turkey within 30 days after flights to their home country are opened.

      1. ok i see this comment we are in the same situation we wouldnt of been if there was no covid 19, i know it seems like deliberate attempt to overstay but is not the case this bugarian citizen would be fined 70 usd, would it be around the same for uk citizans, it proberly will 4 months due to the fact the money comes next month soon money comes through we book the flight and go georgia , hopefully we come bakc next year

    I’m a Canadian student in Turkey and my residence permit expired 10 days ago,

    If I leave the country now and pay the fees, can I re-enter immediately with a new visa? or do I have to spend some time out of Turkey before being allowed back in? Will I face an entry ban?

      If you pay a fine for overstaying, you will not be banned to reenter Turkey. However, as your residence permit has already expired you should stay abroad for at least three months in order to reenter the country. If you enter Turkey earlier you can face a problem on a boarder and most probably would enter the country conditionally, which means that you must apply for residence permit within 10 days upon your arrival.

          According to announcement of Directorate of Migration published on 15.06.2020, foreigners who overstay in Turkey due to Covid-19 should not be fined under condition that they leave Turkey within 30 days from the date since transportation to their home country is possible.   5. Hi I have 2 questions. What are rhe overstay fines for Canadian citizens? And second what happens if touristic residency permit is rejected? Still have to pay overstay fines or just have to leave country within 10 days? Thank you very much.

  6. I am graduated from master’s degree in Turkey in mid june, but my residence permit is valid until mid September. If I would leave the country do I need to pay penalty? I wouldn’t be able to leave anyway, the flights to my countrtiy started in 1st of August. I need to return to country in september to start my phd education and make a new student visa.

      Currently foreigners who overstay in Turkey due to Covid-19 do not have to pay the fine under condition that they exit Turkey within 30 days from the date when flights to their home country start. If you are not planning to stay in Turkey longer than until expiration date of your residence permit you will not face any problems while leaving the country.

          Amount of fine depends on your nationality and is counted as double amount of residence permit fee. You can see amount of daily and monthly residence permit fees according to nationalities in chart provided in the article above.   7. Hi if I have overstayed more than 6 month and for almost 7 month? Can I still come back to Turkey after 3 month or will it be a 6 month ban, then?

      If you pay a fine for overstaying while leaving the country and will not be informed about entry ban you can reenter Turkey after 3 months. If you enter the country earlier you can face problems on the boarder and most probably would be allowed to enter conditionally, which means that you must apply for residence permit within 10 days upon your arrival.

  8. Hi, I am married to a Turkish citizen and I overstayed my tourist visa. I exited turkey on 12/02/2020 and I payed my fine and they said I am not allowed to go in the country for 3 months. I am in the U.K. now and I have applied for my residence permit. I am waiting for my appointment date. I am thinking of going back to turkey on 10/08/2020 of this month. Will I get stopped at the airport?? Will there be a problem?? Will I be allowed in the country ??

    If I overstay my visa by 6 months(2 month cause of No flights/corona) and If I pay my fine, when can I return to Turkey?

    After 3 months and then I get a new Tourist Visa 90/120? Yes?

    But if I return after 1 month, then I have to apply for a permit stay, within 10 days, even if I overstay 6 month?

      If you pay a fine for overstaying you are allowed to reenter Turkey after staying abroad for at least three months. If you enter the country earlier, you can face a problem on the boarder and most probably you would enter Turkey conditionally and will be obliged to submit residence permit application within 10 days upon your arrival.

  10. hi i overstayed in turkey for personal reasons with my parents. my visa expired in march. and now im staying illegaly what should i do im from algeria and if i go to algeria how much time should i stay there to return to turkey ?

      Those, who overstayed their visa in Turkey due to Covid-19 do not need to pay a fine under condition that they leave the country within 30 days after flights to their home country are opened. After overstaying your visa you should spend at least three months abroad in order to reenter Turkey with new visa. If you enter the country earlier you can face a problem on the boarder or enter the country conditionally, which means that you will be obliged to apply for residence permit within 10 days upon your arrival.
