Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hello. I am Greek citizen and I came via erasmus for one semester. I have applied for Residence Permit, but still the application is in progress. At soon I will have stayed in Turkey more than 90 days and I don’t know if I take the Residence Permit before my departure. Will I have to pay at airport and about how much money if I stay 1 month more?

    1. Hello Nikolaos,

      Thank you for your comment.

If you do not exceed 90 days in Turkey, there is no problem. You can go abroad and return on the new tourist visa and your application will not be canceled.

      Kind Regards

  2. Hello,
I would like to have an explanation on a specific situation:

I am French and currently living in İstanbul. I arrived in September and my tourist visa is coming to an end. I have applied for the residency and have an appointment for the 26th of March 2018. So far so good but my problem is that I will need to go back to France at some point for administrative appointments, therefore I would like to know how it works with the customs.

Do I have to leave Turkey before the end of my visa even if I have the residency appointment, or can I overstay, then leave for France anytime in between the end of my visa and the appointment and come back without being fined or banned? And if there is a Fine, do you know how much it will be?

Thanks a lot for your time! Cheers

    1. Hello Benjamin,

Thank you very much for your comment.
I understand that you have applied for a residence permit during your visa. If so, before your visa expires, you can leave Turkey and return to it on the new tourist visa. Your application for a residence permit will still be valid. You will only have to wait for the appointment.

      Kind regards

  4. Hello, we arrived Turkey 7 of October, we can stay legally till 5 January. We are trying to take an appointment from the website but it show all the time no places for appointments, if we couldn’t take an appointment what could we do in this case? And if they give us an appointment after January 5, let’s say in February 5, should we pay penalty? Any suggestions what to do? Thank you

    1. Dear Mr Ziad,

      Thank you for your comment.

You must make an appointment before the visa expires. If the validity of your visa ends on 5 January, this means that you must make an appointment before the expiry of this date. The meeting will definitely take place much later than in January, because a lot of foreigners apply for a residence card. As I wrote before, it is IMPORTANT that before the expiration of the visa appointment must be done. If you would like our company assist you throughout the whole process, please contact us.

      Kind regards

  5. I don’t understand the fee table. I have an American passport and I have overstayed my ikamet by 78 days (I applied for an extension, but was denied because I don’t have a permanent address). How much can I expect to pay, and can I use a credit card to pay the fee at the airport?

    1. Dear Andy,

      Thank you for your comment.

The amount of the penalty will be about 500-1000 TL. Must be paid in cash at the airport.

      Kind Regards

  6. Hi there,

My e visa 90day period finished in july and the expiration of the visa finished in September.

I am planning on leaving soon.

    My questions are

    1. Does the fine start from thw 90th day or the 180th day

    2. I haven’t got a valid excuse apart from I love the country but couldn’t find the means to support myself. So I don’t have a excuse. Will I get questioned?

Do I go at the normal time and through the normal check in process and then be requested to pay the fine?

    1. Hi Sha,

      Thank you for your comment.
The calculation of the penalty begins after the expiration of your visa.
The visa allows you to stay in Turkey for 90 days within 180 days. After using the residence limit in Turkey, the penalty begins to be calculated.
You can expect a fine of 500-1000TL payable in cash at the airport.

      Kind regards

  7. How much is one day over stay cost in Turkey if , and how much if you have been have an over stay for 1 years 8 months . how much will be the cost and also will i get a BAN ? if YES is the any procedure that i can follow to avoid having a BAN in the passport .

Your respond will be highly Appreciated .

    1. Dear Mr. Robert,

Please be informed that the administrative fine is calculated by the Customs officer on the departure day and the penalty amount depends on the country of origin of the foreigner. In order to avoid the ban, I ll strongly suggest you to pay the fine. If you will not be able to pay the penalty, you will get a re-entry ban for 5 years.

      Thank you,

  8. If I overstay in turkey, get out of the country paying the fee, when can I come back? Is there a period or I can enter in the same day?

    1. Dear Mr. Daniel,
Thank you very much for your message.

It depends on the Customs officer’s decision. Generally, if the foreigner is paid the administrative fee, he may come back to Turkey at any time on conditional entrance and apply for residence permit. However, there is some cases when Customs officer apply a re-entry ban and foreigner is banned to enter Turkey for certain period of time. If foreigner is failed to pay the penalty on departure day, he will get a re-enrty ban for up to 5 years.

      Thank you,
      ExpatGuideTurkey team.

  9. Hi,
This past summer I had over stayed by 15 days on the exit out the country paid the penalty at the airport, next summer planning to go Turkey again should I will have any problem getting in to the country .Thanking you in advance

    1. Dear Mr.Selahattin,

If you pay the penalty on departure day and Customs officer doesn’t inform you regarding the re-entry ban, you should not face any problems on your entrance to Turkey next year.

      Best regards

  10. Hello,

Is it possible to buy a touristic visa once the residence permit is expired, without leaving Turkey?

    Thanks.

    1. Dear Mrs Julie,

Unfortunately a new Visa cannot be taken without exiting the Country. In order to get a new Visa you need to exit and re-enter Turkey. Also if you have overstayed you will have to pay a penalty at your exit of Country.

      Best Regards,
      ExpatGuideTurkey Team
