The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    My family got zyrait visit visa for istanbul for 15 days. Do you know how can they extend it
    Also are they allowed to start residence permit with visit visa? And will waiting for the appointment make them trouble?

      Foreign Citizens coming to Turkey with a visit Visa are allowed to apply for a family residency permit. Please note that if an application for a short term touristic residency permit is made, it might get rejected.
      Waiting for the appointment will not be a problem even if their visa expire. However the application must be done BEFORE the expiration of the residency permit.

      The penalty for overstaying in Turkey is calculated at the cutoms by the officers. We cannot tell the ammount you will have to pay. However the ammount you will be asked to pay should not be more than a couple of hundred of Turkish Lira.

    My tourist visa is expiring the day after tomorrow, at which time I have booked a flight out of Turkey

    However a family member now wants to visit and requested I stay a few more days with them, which means if I decide to overstay it will be 4 days

    According to your info I’m due to pay a minor fine but otherwise will be in the clear. However I cannot find any sources from the Turkish government online or here to confirm this.

    Will staying a few more days adversely affect my ability to come here for tourism in the future? Or will I be able to obtain tourist visas in the future

      If you overstay in Turkey for a couple of days and you pay you penalty at your exit you will be able to re-enter Turkey on a touristic Visa. However if you overstay a second time you might not be able to get a touristic Visa.

    My name is Amjad and I am a syrian sculptor. I have been in Turkey for 2 years now and I have a “kimlik”, which makes me legal here but I can’t re-enter Turkey once I leave it. The immigration office said that they could not transform it into a residency permit, that I had to leave the country (and give back my kimlik -given only once) and try to get a visa instead, from which I could potentially have more chance to get a residency permit in Turkey.

    The thing is that my wife is french, and she lives and work as a teacher in a University. I am currently expecting a french visa, that would allow me to leave Turkey and do my visa application to come back to Turkey to live with her, so a visa for family unification purpose. Are the chances to obtain it high?

    Do you have any advice or information on this matter, or another suggestion to help me also get a residency permit after this 90 days visa in Turkey?
    Also, I am working non officially in an art school as a sculptor, and I might do exhibitions soon. If the director of the school invites me for work or art fair, could it be helpful for the residency permit?

    1. Dear Mr Amjad,

      If you can apply at your re-entry of the Turkish territory with a touristic Visa you will be able to apply for a family residency permit. According to the Turkish law foreign citizen wishin to apply for a family reisdnecy permit must have a valid Visa with touristic purpose. In the case that you get an invitation from an organisation or person you will get a visitor Visa which will not allow you to apply for a family residency permit.

    Six months ago when I was in Afghanistan, my family had an appointment with the immigration office about the residence permit. They went to the immigration office exactly on their appointment date, but their documents were not complete so the immigration office told them to complete their documents and revisit the stated office after a month.

    Since I was not with my family, they could not prepare the requested documents in one month and they missed their second appointment. After six months, I am in Turkey now. I want to get their residence permit. Would you please tell me what should I do?

    1. Dear Mr Arian,

      Unfortunately if your family did not provided the required document in the time given by the immigration office they will mostly need to re-apply for a residency permit and will mostly be considered to have overstayed.

      If they have been overstaying they will need to leave the contry and re-enter with a valid touristic visa and then apply for a residency permit. Please note that since they are mostly in overtaying position, they will have to pay a penalty at their exit of territory.

  6. Hi,
    I have student ikamet valid until September. I will be graduating in this month and will be leaving Turkey in July. I have heard that they cancel the ikamet as soon as one graduates and its compulsory to leave Turkey within 2 weeks. My ikamet says that its valid till 17 September. I mean is it not weird, if such rules exist, that I cannot be sure when they will cancel the ikamet. Also, do they send any email or text message that you have graduated and now you have two weeks to leave? Please send any government site link where I can know about such rules.

      According to the law related to the immigration of foreign citizen, students who grauate from Turkey have to leave the Turkish territory within 10 days of their graduation. The graduation date is the one given to the immigration office by your school. To know the exact date of your graduation you should check with your school. In other word you residency permit will not be valid until september.

    can i apply for “HUMANITARIAN RESIDENCE PERMIT”?

      You “can” overstay in Turkey for an indefinite ammount of time. However if you overstay you will have to pay a fine at your exit of country and also you might get deported.
      The fact that you own a house does affect you residency permit application, however as metionned bellow the passport is mandatory for the application.
      In order to apply for a humanitarian residence permit you should prove that your life is in danger in your home country. Bu this kind of residency is very different.

    i’m Egyptian and I’ve been living in turkey for 3 years now with legal short residence permit that i have been renewing every year.
    my current residence permit will expire in about 2 months so is my passport
    i tried to renew my passport but the Egyptian government refuses until i go back and serve 5 years in the army
    i’m a student in a Turkish university (sabahattin zaim) 2nd year so going back to waste 5 years of my life will destroy my future
    is there is any thing that can be done to renew my residence permit without renewing my passport?
    i own i house in turkey if this can help

      Unfortunately you are required to get a valid passport if you wish to apply for a residency permit in Turkey. However to get a bette answer to your question, you should go to the immigration office and check if they can make an exception.

  9. I am a libyan national, I plan to spend the 2017 summer holiday in Turkey, i have a one year multiple tourist visa with 30 Day stay.
    i already have a return flights which makes me overstay by 11 days. meaning i will be staying 40 Days instead of 30 Days.
    Do i have to pay a fine, how much?
    Although i have a multiple entry visa, Do i have to obtain a new visa because I overstayed?

      Yes you will have to pay a fine since you will be overstaying. You should pay the fine at your exit of country. Also you will have to apply and get a new visa in order to enter the Turkish territory.

  10. Hello!
    I came to turkey on 31st December 2016, I applied to residence by march, 27th and had my interview 2 weeks later.

    Today, 12/06/2017, still i didn’t get my residence permit yet.

    The issue is that :
    – I applied for 3 months residence only and not a full year
    – Why 3 months only ? because my passport is valid only until August 2017!! so I need to go back to my country to renew it!!

    What I can do is this case? when shall I book my flight ? do I need to get any document from any Turkish administration to travel without future ban.. ? Will I pay any penalties at Turkish borders?

    1. Dear Mr Levent,

      As i understand the immigration office provided you with a 3 month residency permit only. The residency permit will be issued to you according to the expiration date of your passport, they will give it the most at 2 month until the expiration of the passport. In order to get a new residency permit you will have to extend your passport.

      If you had a residency permit of 3 month from the 27th of March, it should expire the 27th of June. However we cannot confirm the expiratiıon date exactly. The officer should have told you at your appointment.

      In this case you have to get a new passport and then apply for a new residency permit.
