FOREIGN ENGINEER WORK PERMIT – TERMS AND CONDITIONS

With the provision of the latest law no. 6735 namely International Workforce Law, Article 21- the issue of work permit for foreign engineers and architects is specified.

It is provided that any foreign engineer and architect may work in Turkey in project-based works or as temporary workers if they have already gained their titles by completing their education in one of the faculties of engineering or architecture at a university in Turkey, or, any other institutions of higher education abroad which are accepted by relevant Turkish authorities and Turkish Council of Higher Education. Thus, providing opportunities is aimed for all foreign engineers and architects who are counted as qualified personnel and who undertake the key roles at the top-line projects performed in Turkey.

ARTICLE 21- (1) According to the law, foreigners who who have gained the titles “engineer” and “architect” by completing their education in one of the faculties of engineering and achitecure in Turkey or any other institutions of higher education abroad which are accepted by relevant Turkish authorities and Turkish Council of Higher Education, may perform their professions with the work permit, working project based or temporarily.

Attention:  : There are two obligations to the firms that will apply for their foreign personnel’s work permit: YÖK (Turkish Council of Higher Education) Accreditation, and registry for Chamber of Engineers. No matter what the title is, Sales Engineer, Food Engineer, Software Engineer, Civil Engineer, Mechanical Engineer; if the foreign personnel applies for the position of any of the engineering branches, they must have “YÖK” accreditation.

HOW TO GET WORK PERMIT FOR FOREIGN ENGINEERS?

Ministry of Labour and Social Security is in charge of giving permission to foreign workers. For foreign engineers, a “Certificate Accreditation” that is eligible for Overseas Higher Education Certificate Legislation of YÖK (Turkish Council of Higher Education) is required.

Applicants must have the documents which indicate that they have been working as an engineer, that they are a member of the trade body, and they have not been prohibited from their professions. The documents must belong to a date at least six months before the application. The original copies of the documents must have the apstille stamp from the applicant’s own state’s administrative unit. Applications can be done online yet the documents must be on paper.

Applicants must have their documents approved by Turkish representative offices that are settled in their country before sending them to Turkey. The applications for work permit are finalised within 30 days providing that the documents are in order as required. The applicants are informed in case of any lack on papers so that they can supply their documents correctly. 30-days period starts the day the documents are sent to the Ministry without any lacks.

The workplace that the applicants apply for must have at least 5 Turkish employees and must document these workers’ SSK (Social Security) pay rolls. Minimum wage standards after the application are considered while amount of salary is offered by the employer. The criteria for the payment of foreign engineer work permit is at least quadruple the minimum wage. It is obligatory for companies who employ foreign engineers to also employ at least one Turkish engineer. It is necessary to specify that the salary will be at least quadruple the minimum wage. The original certificate of engineering must be submitted to the Ministry while applying.

These criterias are not applied to Syrian Engineers who have Turquoise ID Card.

      You can not apply for another work permit while your cuurent one is still valid. Howevwer, your current employer can make work permit transfer with future employer so you will not need to apply for residence permit in the meantime.

    Please I hold a master degree in industrial engineering from Morocco, and bachelor degree in civil engineering,and I have job offers for sales engineer and industrial engineer.

    1-Is it mandatory to apply for equivalence for the diploma’? The company asked me only for my bachelor degree diploma to serve as engineer

    2- if a company started the work permit process, but I decide to work with another one, should I cancel the previous process or transfer it? And how

      For foreign engineers it is required to obtain the equivalence of diploma in order to work in Turkey. If the work permit has not been issued yet, application should be cancelled if you will not work in the company, which applied for your permit.

    I recently received a work contract with a turkish company. In order to apply for work visa I was asked to make a security deposit-by Western Union and IN MY NAME -not in an account.
    Is that the real requirement /procedure or could be a scam ?
    The company confirmed the autenticity of the contract.

      This kind of deposit is not required as a standard procedure for work permit application. Please, be careful and do not make any payment in advance as long as you are not sure if the offer is real.

    I am an Indian national who has received a job offer from a big company in Turkey as an Export specialist. I am an engineer by education and currently not residing in Turkey. The company has sent me the application form as well as list of documents to submit.
    I wanted to know 3 things viz.
    1. The work permit which I shall receive would serve as my residence permit as well?
    2. For my profile, what would be the average salary for a Turkish employee taken into consideration and by how many times should my salary be more?
    3. In how many days does the HR receive the Reference Number? And is the Reference Number proof that I have received the work permit?

      Your work permit will be your residence permit as well. As an export specialist, your minimum salary should be 1,5 of minimum wage, which means 2.558,00 x 1,5 = 3.837,05 TL. Reference number will be given to you by the Turkish Consulate/Embassy if you are applying from your home country. It will be required during application procedures and is not a gurantee of a work permit being granted.

          With regards to my above query, I have been informed by the company that I would need to take an appointment with the Turkish Embassy in Paris (since I am currently holding a resident permit in France), after which I shall receive the reference number (which I would need to furnish to the company for the work permit application). My question is:

          In the website of the Turkish Consulate, do I need to select on ‘Work Visa’? I am getting confused since they mentioned about Work Permit and not Work Visa. And will I get the reference number on the same day of the appointment (considering all the documnts I submit on the day of appointment are fine)?

      Unfortunately, we can not help you to find a job in Turkey, you can find one via websites like kariyer.net and after you find one, your future employer must apply for your work permit. Foreigners can not apply for work permit in their own name or without having a job in Turkey. Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country. Work permit application can not be submitted basing on visa.

  8. I wanted to know how the employee will determine whether an engineer fall within the 6.5 or 4 times the wage rate bracket. A lot of sources online states that the salary for foreign engineers should be 6.5 times the base pay if applying for preliminary work permit, otherwise it can be 4 times. I wanted clarification as to what the legislation mean by preliminary permit?

      Preliminary work permit applies to foreign engineers who have not received accreditation from Turkish Council of Higher Education yet. This kind of permit can be granted for period not exceeding one year. Salary paid to foreign engıneers with preliminary permit must be 6.5 times the minimum wage.

    I am a foreiner, Energy Engineer graduated from a University in Turkey last year,
    My Residance Permit is registered in purpose of “Students who graduated in the last 6 months” it will be expired in 3 months.

    as I have read it should be at least 6 months , so if I have to extened it what should be the purpose of extention for residence permit in order to be able to work in Turkey?

    I already found a job in Turkey but still trying to get work permit.

    the company have about 20 employees I am the only foreigner.
    Im not registered in the chamber of Engineers.
    I still have no experience so İ am not an expert, is ıt neccessery that the employer pays 4 times minimum wage in Turkey?

    What should be done so than I can be able to get a work permit?

      To obtain a work permit you need to have residence permit with total validity of at least 6 months, no matter how many months is left until the end of its validity. To work as an engineer, you will need to get registered in the Chamber of Engineers and at least the minimum wage for engineers must be in your job contract.
