The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.
| 90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit. |
An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.
ADMINISTRATIVE FINES
In case of overstaying tourist visa (or breaching 90/180 days rule) or exceeding validity period of residence permit, foreigners will be subject to administrative fines. According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee and single entry visa fee. (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY
An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.
In case of an overstay of less than 10 days, no entry ban will be imposed. Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the Ministry of Interior Directorate General of Migraion Management –Frequently Asked Questions about Foreigners.)
The Length of ban is approximately corresponds to the length of overstayed period. Notification about the entry ban period and the administrative fine is issued at the border gates. In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.
Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4 Law no 6458 on Foreigners and International Protection)
Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

Hi, Could you help me with the details i can’t quite understand the fine price is it fixed or it depends on the officer i would like for you to tell me how much i should be expecting to pay ( don’t need exact amount just give me your best guess) my 30 day E-visa is expiring i am planning to overstay 3 days. I have alien’s passport from Finland (not nationality passport) so i don’t think the 180 days rule works for me please could you give me details and 1 more thing my flight is going from ataturk airport 8:30 morning what time should i come before the flight and where do i go to pay the fine? do i go straight to the passport cantroll or is there is some kinda office for vailoting the tourstic Evisa that you can pay the fine from?

Most probably for only 3 days you will not be fined at all or you can be fined with minimum amount of around 10$. You should come earlier than planned but it will not take a lot of time, half an hour would be enough. We would recommend you to go directly to the information point after arrival to the airport.

Hello, i am from Turkmenistan and i will overstay for 5 days in Turkey because my Russian visa will be ready at the 20th of July. And my permission for staying will be expired at the 16th of July. I want to know how much i will pay for 5 days?

For overstaying less then 10 days no fee may be imposed or you may be fined with the minimum amount of 10-20$. The final decision on the amount will be taken by the customs at the airport.

You should go to the office at first to get to know if the fine was imposed and if yes, what would be the exact amount

I have been legally residing in Turkey on a student resident permit since 2014.
My resident permit expired on the 1 July, 2018. I couldn’t extend it before the expiration date because, I was waiting for my new passport.
I received my new passport on the 4 July, 2018. Then I tried to make an application for extension i couldn’t. So, I had to make an application for new resident permit for which my appointment has been set for 11 September, 2018
While I am waiting for the said appointment without a valid resident permit. What should/must I do?

Hi, I am from Pakistan and I have the US VISA as a supporting document to get eVISAI travelled in and out a lot since November 2017 and lost track of time. Last time when I was exiting Turkey in May 2018, the immigration officer asked me to pay around 300TL fine, because I stayed 108 days in the last 6 months. I paid the fine and no ban was imposed on my stamp; it’s a normal exit stamp. I have to go back to Turkey again for about 25 days, and probably very soon on a normal one-month eVisa. My stay in Turkey is around 85 days in the last 6 months as of this moment. My question is: Do I have to wait till this 180 days cycle is over and my stay days in Turkey are back to zero OR I can travel now and stay for 25 days?

180 days period in 90/180 visa is counted from the first day of entry with the visa. You can obtain a new visa and come to Turkey after 180 days since first entry passes. Otherwise at the airport you will be asked to sign a document stating that you will apply for residence permit within 10 days upon arrival and if you would not be able to finish the application process, your stay in Turkey would be considered as overstaying again.

Thank you so much for the response. What are the chances to get a residence permit for just tourism purposes? and will 10 days be enough to get everything done like documentation, application submission, and getting the permit?
Also, I would really appreciate if you can please share the total cost for this residence permit. (I have a Pakistani passport) and documentation list.
To apply for touristic residence permit you would need to rent or buy a house in Turkey, prove that you have enough financial resources and health insurance for the whole period of your stay and also present non criminal record from your country. But remember that, especially in İstanbul, there is possibility that your application would be rejected. The whole process can take up to 3 months but you can legally stay in Turkey until you receive your residence permit card.

I was living in turkey for last 1 year. 2 Weeks ago i came out of the country for a business trip to Europe. I had Ikamet which was expiring in August. Whe i reached the immigration Counter, they told me that my Ikamet is cancelled by the ministry. I want to know that how can they cancel my residence without any intimation to me specially after it was issued to me? I was made to pay the fine as well.

As we do not know any details of your case, we can not give you any specific answer. İf some of your actions were against the rights and duties connected with being a holder of the residence permit in Turkey, it can be cancelled but you should be informed about it. You should contact immigration office and consulate to ask for explanation.

Thank you very much for such a quick reply. I have 2 questions.
First, they fined me, gave me a receipt but they didnt put an exit stamp on my passport. It was a normal stamp like everybody else.
Second, I am going back in 4 days. I usually get my evisa online. I purchased a house in Turkey where I live. What are the chances that they would refuse my entry in the country. However, the guy who informed me about the cancellation at the airport said that coming back would not be a problem. I sent the Directorate of Immigration mutiple emails, they never replied.
İf you received just a stamp with no information about re-entry ban to Turkey, you can come back with no consequences. İf you come back after 4 days, you will most probably receive a document to sign at the airport, stating that you will apply for residence permit in Turkey within 10 days upon arrival. Because you have property in Turkey, you should apply for residence permit for property owners and if there is no circumstances connected with cancellation of your previous residence permit that could affect the result of new application, you will be allowed to stay in Turkey.

Please i need some infos, I applied for residence permit and yesterday was my appointment, they refused the application due to a mistake made by my agency.
the guy at the ministry of foreign affairs turkey suggest that i have to leave the country for at least 3 days and come back, is that right? (people do this all the time)
I finish my 3 months the 8th Juin but i was staying legaly because of the appointment, but now they told me i have 10 days to leave without a band at the airport but a have to pay a fine!
Can i leave for 3 days and come back again to turkey wouldn’t that cause me a troubles at the airport!

İf your application was rejected you still need to pay the fine for the period of time spent in Turkey after your visa expired. İf you come back in 3 days with new visa, you would be asked at the airport to sign a statement that you will apply for residence permit within 10 days after your arrival.

My fiancé is being held at an airport in istanbul turkey. He had overstayed in turkey. Was held until payment of $2500 was paid. Upon traveling to airport to LEAVE turkey he was involved in a fatal head on collision. Has been in hospital in istanbul since accident on 5 /18/2018. NOW they are requiring him to pay again for overstaying. But he was in the hospital under Drs care. Can they LEGALLY force him to pay again even though he was in hospital.

İf he paid the fine already before and have some documents to prove that he was in hospital since then, he can try to refer to those but in this case consultation with a lawyer might be needed because this case is not in a scope of our competences.

Hello I am a Pakistani, recent graduate from a university in Turkey. My residency card is expiring on 30th June 2018. I am looking to apply for 6-month new residency permit card. However, due to passport renewal problem I cannot apply for the new residency permit right away and will be able to apply by 5-7 July 2018 (which is 5-7 days after the expiry of my residency permit). So, I wanted to ask you if I can do this and what other consequences will I face? and if I face any fines, where will I pay them? Thank you.

İf you will not be able to apply for residence permit before the end of validity of your current one, you will need to leave Turkey and come back on a new visa to apply again. İf you would not be able to leave Turkey within 10 days after your residence permit expiration date, you will pay the fine for overstaying at the airport.

hii, my ikamet expired feb but i applied for a renewal as a tourist and the system gave me june as appointment date. i went for the interview and three days later i was sent a message that my application was rejected. my husband stays here and he has a work permit. can i apply again on family residence basis. then how do i go about it. thanks

İf your husband stays in Turkey with work permit for at least a year, you can apply for family residence permit on this basis. But still you need to leave Turkey, paying the fine for overstaying at the airport and come again with new visa to be able to apply for residence permit. Hi,I’m from Brazil and I overstay in 1 day (91days in 6 months). I pay 622liras but I want come back in 20 days and stay more 12days. The police attendant told me I can come back but should apply for resident visa. Did you know if I really need apply for this resident visa or can I just pay the fee again? Thanks

You should wait for another 90 days to be able to come back to Turkey without consequences. İf you come earlier, you would need to apply for residence permit within 10 days upon your arrival and stay in Turkey until the end of application process. Otherwise you would pay the fine for another 20 days and most probably would be banned to re-enter Turkey up to 5 years.
