The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hi! Im from Sweden and i overstayed the 90 days rule in 180 days by 11 days. I Did not have the time to pay the fee in the AirPort in turkey so What sort of visa Will i apply for to be able to go back This year for Two weeks holiday? Normaly We dont need visa from Sweden. Sincearly Beatrice

      As you did not pay the fine, if you would get banned to re-enter Turkey, you should be informed for how long you can not enter the country again. You should contact Turkish Consulate if you are not sure if you were banned. İf there was no entry ban, you can come to Turkey after 180 days from your last entrance pass. İf you come earlier you might not be allowed to enter or you would need to apply for residence permit within 10 days after arrival.

  2. Hi,
    I can’t understand that the amount of “Fine” depends on the officer. If there is a fixed rule for calculation of fine, why it depends on officer?
    I’m really worried. Based on the above mentioned table, I guess I should pay about 78$. What is the maximum range of fine according to officer mood? May it be more than 100$?

      Unfortunately, in Turkey very often fixed rules are still changeable up to various conditions. There should not be very big difference (if any) in the fee amount but just in case be prepared to pay some bigger fine from what you calculated.

  3. Hello,
    I have asked for a short-term ikamet at the beginning of march. My appointment to get it is at the beginning of july. I already stayed more than 3 months from march. Unfortunately, I have to go back urgently to France because someone has a serious disease in my family. I can not wait for july to go back.
    What will happen ? How much should i pay ?

      You should pay the fine at the airport. İf you refuse to pay, you will be deported and might be banned to re-enter Turkey for up to five years. Amount of the fee is calculated by the customs at the airport so we can not give you the exact costs but if your visa expired in the end of march, it should be around 30$.

  4. hi, I was in turkey last year and had communication problems regarding my residence permit when I returned in January I was given 10 days to apply for permit unfortunately the website was down at the time and I couldn’t make an appointment I left 50 days later and had to pay a fine of 300tl I then tried to enter turkey two days ago and was told I had to come back to the uk and get a different visa, how would I do that do you know who I should contact as I have tried contacting the Turkish consulate in London with no luck

      Most probably you were banned to re-enter Turkey for overstaying twice but because of communication problem you might have not been clearly informed about it. The best solution in this case is contacting the Consulate to get the information if you were banned. As often it might be difficult to contact the Consulate via phone, you just need to be patient or, if needed, go there in person.

  5. We overstayed over tourist visa with 39 days and had to pay 517 lira each . My husband and i. We have misunderstand the system of apply for recident of visa. We though 90 days duration was singlestay and that we had to wait for apply recident of permit to our touristvisa expired. We rent apartment . We have all our bélongings in the apartment we have also a dog . We should only take a holiday to egypt for 1 week. We paid our finé explain our mistake to the police. He told banned first 180 days but after explain he told we should take good care of recit. Now we return in 2 days. Will we be able to enter? I have bought a New touristvisa i also apply for ikamet online and have casenumber . Just need doçumentation and they are in our apartmemt. Will we be able to enter? We have moved from our apartment in norway. Or will we still be banned for 180 days. Policeman told we should say recidene card in bad English. Please help us. We want to come home to our turkisb home

      As you paid the fine, you will probably need to sign a document at the airport which states that you will apply for residence permit within 10 days after entering Turkey. You should also explain the misunderstanding again upon the arrival as the final desicion on your case will be taken by authorities at the airport.

    I applied for a residence permit before my 90 days tourist visa expired, but there is a long wait still until my interview date (nearly 3 months in total). I know I can’t leave the country until the interview is complete, but am I still free to travel around the country? Will I have any problems at the airport getting on a domestic flight?

      You can legally stay in Turkey until your appointment date and you can also travel within the country but make sure to have your residence permit application form with you as a proof of your legal stay.

    I’m repeating my previous comment in English, in case Turkish-speaking staff is not available.
    My fiancé of Egyptian nationality has recently obtained his touristic Turkish visa with a 30 days stay permit. We actually applied for 60 days of stay due to family reunions and special occasions in Turkey, so now we’re trying to figure out ways to extend his stay.

    If we overstay the limit of his 30 days, will he face legal problems during his future travels to Turkey? Can we simply pay a fine for 10 additional days of stay and not get into trouble with the authorities? Do you happen to have any idea if there’s any other way we can extend his visa by one more month from inside Turkey, while we’re there?

    We would appreciate any guidance or help.

    Misir uyruklu nisanlim bugun 30 gun kalis sureli Turkiye vizesini aldi. Biz 60 gunluk basvuru yapmistik ve aile toplantilari, dugun vb. planlarimiz oldugundan buyuk hayal kirikligina ugradik.
    Acaba vizesi 30 gunluk verilmis oldugu halde, 90 gunu gecmemek kaydiyla daha uzun kalirsak ileride Turkiye’ye girisinde yasal problem yasar miyiz? Problem yasamadan, sadece ceza odeyerek kalabilecegimiz sure o 30 gune ek 10 gunden mi ibaret? Ya da vizeyi Turkiye’deki herhangi bir kurumdan 1 ayligina daha fazla uzatma imkanimiz olabilir mi?

    Yardiminiz icin cok tesekkur ederiz.

Merhaba, vize tarihinizi Türkiye’den uzatabilmenin maalesef bir imkanı yoktur, vizeniz bittikten sonra 10 gün içinde Türkiye’yi terk etmek zorundasınız daha fazla kalırsanız fazla kaldığınız sürenin cezasını ödeyerek çıkış yapmanız durumunda tekrar geldiğinizde herhangi bir sorunla karşılaşmazsınız.

Hi, my working visa was cancelled and i am overstaying alreadt but i am married turkish man national , what would be im going to do to get resident permit now that i am married here… Please help me… They advised us to exit the county is that be the way to get rp?       As you have overstayed already, you need to leave Turkey and apply for visa in a consulate basing on your marriage certificate. After you come back to Turkey you can apply for family residence permit.
