RE – ENTRY BAN FOR OVERSTAYING IN TURKEY
An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.
In case of an overstay of less than 10 days, no entry ban will be imposed. Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the Ministry of Interior Directorate General of Migraion Management –Frequently Asked Questions about Foreigners.)
The Length of ban is approximately corresponds to the length of overstayed period. Notification about the entry ban period and the administrative fine is issued at the border gates. In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.
Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4 Law no 6458 on Foreigners and International Protection)
Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

Hello I saw the residence. Permit overstay penalty chart
But I have read it depends on the officer at airport. So which one is the truth as I have overstayed and need to leave
Hi,
Thank you for your comment.
It is true. The final decision on the amount of the penalty for exceeding the stay is made by the officer at the airport.
Kind Regards
I overstay my residence permit very long period is there a chance I could apply to exit the country try at the immigration office or do I have to go strait passport control at airport
Dear Rana,
Thank you for your comment.
In such a situation you will have to pay a penalty at the airport in cash. The final decision on the amount of the penalty is made by the officer at the airport. If for some reason you will not be able to pay a penalty, you may be banned from entering Turkey for as long as five years.
Kind Regards

Dear Anama,
Thank you for your comment.
Of course you can leave Turkey. You will have to pay a fine at the airport in cash. If you do not do it, you may be prohibited from entering Turkey for up to 5 years.

Thank you for your comment.
Unfortunately, you will have to pay a penalty at the airport in cash. The amount of the penalty depends on the officer on the border. If for some reason you will not be able to pay a penalty, you will not be allowed to enter Turkey.

Hi,
I am from Belgium and am staying in Turkey in a 90 out of 180 days tourist visa.
Recently, I noticed I was about to overstay those 90 days, so before they ran out I made a residence permit appointment. This appointment was about 6 months from the requested date. A while after, I had to leave Turkey for vacation, so I had to pay an overstaying fee. I had to pay about 120TRY, for staying 100 days out of 180 instead of 90 out of 180. A few days ago now, I reentered Turkey, and they took me to one of the border control places. There they eventually allowed me to enter, and told me if I left Turkey again, I would receive a ban from Turkey. Now I was wondering, should I not, since I have a residence permit appointment be allowed to leave and reenter? and besides that: I want to have an idea of how long the ban would be. I am currently in turkey for 102 out of 180 days, and would like to leave again in 2 weeks, so I will be 120 / 180 days. Does that mean I will receive a ban for 30 days because I overstayed for 30 days? or 120 days?
Thanks,
Jan
Hello,
Thank you for your comment.
You should immediately obtain a residence permit card. Controllers on the border are not always so kind. Since you have already applied for your residence permit you should go to a appointment date at the Immigration Office and finish it.
In some cases, an entry ban can be obtained for up to five years.
Kind Regards
Hi, thanks for the reply. The appointment is only in 2 months, my vacation for which I have to leave Turkey is before that. Does that mean I can’t go on vacation if I do not want to be banned from Turkey?

Hi my friend is In Turkey now. He was taken to Turkey by an agent promising him a job and now he is over stayed for two months and his agent has left him. He went to airport with a oneway ticket to fly his country and he was caught at the boarding counter with a fake resident visa stamped in his passport. After few days he was asked to be free outside Turkey with a paper saying he should leave the country in 15 days. But they have not given the passport. How can he come back. He is willing to pay over stay charges.
Hello,
Thank you for your comment.
The situation of your friend looks complicated. Officers at the border should hand over his passport. Unfortunately, we do not know exactly the whole situation.
Kind Regards

Hi,
