The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hello,
    I stayed in Turkey 91 days, I was thinking I counts the days right so I can leave Turkey for few days and come back for another 90 days. But when I was in the airport, the officer informed me that I stayed 1 day more and I’m not able to come after paying the fee until 3 months pass. Mu question is how can i come back before 3 months? My engagement party is the end of March + I need to continue my Turkish classes. Just wondering what kind of othet options may help me to come back before the 3 months period.

      As you have already used 90 days, you have to stay abroad for another 90 days in order to purchase new e-visa and be able to come back. Otherwise, you may apply for work visa from abroad and be able to come to Turkey on work permit. For work visa application, you have to find a job in Turkey.   2. I applied for asylum in 2014 in Turkey,I said under the title of Asylum seeker until 2015 October.I got deported then back to Jordan.(Turkish immigration office paid the ticket).
    I don’t know if I have a ban (Nobody told me at the airport and it doesn’t reads ban on my passport).
    I like to enter Turkey now 2018 February.Should I expect a ban or how can I know before buying my ticket to Turkey?

  3. I will receive my diploma in march and my residence permit as a student is valid until November
    Does the residence permit get cancelled or something and if so how much time can i stay afterwords ???

      If your residence permit was valid until November 2017 and you have not extended it, this means that you are currently staying illegally in Turkey. After expiration of the permit, the foreigner has 15 days to leave the country without paying a penalty. If you have exceeded these 15 days, this means that you will have to pay a fine at the airport. The penalty depends on the officer on the border. You must pay in cash. If you do not pay a penalty, you can get a ban on re-entry to Turkey.

    my residence permit will finish next month but i am planning to stay an extra 15 days then go out of the country come back after 2 weeks as a tourist
    how much fine should i pay….and is there a kind of ban…..

    my case is like this :

    i entered turkey on 28 Aug 2017 with my Jordanian passport on a 90 Days visa.

    I applied for an appointment for the residency permit , got it on 29 Nov 2017

    i went to the appointment and they requested extra papers from Jordan like bank account balance and a clean criminal record ( that will take 2 months to be issued from the embassy ) the criminal clean record issuance date is 5 Dec 2017 and had all the legal government stamps from Jordan and translated to English.

    i got the papers today 3 Feb 2018

    but I was told that I have only 30 days to get the requested papers and get back to the appointment again but it took 60 days

    am I considered as an overstayed person ?

    And what will be the procedure when I get back to the residency office and show them the papers and tell them that it took two months to be issued .

      Before submitting an application, you should know which documents you need and how long it may take to settle them.
      You can go to the immigration office and ask what you have to do. You will probably have to leave Turkey.

    i have one month visa and i have applied for resident permit. My appointment
    date is after my visa expires that is in April. Do i have to pay fine. I am planning to stay in Turkey till the appointment date.

    My daughter’s residence cart is expired 4 months ago and i realize it nowadays

      Hello, your child can get a residence permit by making an application to re residence permit to less than 8 years old, but the age of 8 is greater to make entry and exit from Turkey and will need to contact the then residence permit, you can get clear information by calling 157.

  9. Hello,
    Im allowed to stay in Turkey 180 days, 90 days at once. Next week my 3 months period will end but I’m registered to a Turkish language class since a month ago & would like to continue. What’s the best I can do to avoid any trouble? Putting in mind that I will need 3 more months only to finish my language course.

    My resident permit validates till March 1. But i can leave Turkey only march 5 or 6th. What would you advise? how it would be cheaper- to extend my residence permit or to pay the fee at the airport? im from Lithuania by the way/
    in any of the case i am afraid to get the ban as i will want to come back here in few months
