The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.
| 90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit. |
An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.
ADMINISTRATIVE FINES
In case of overstaying tourist visa (or breaching 90/180 days rule) or exceeding validity period of residence permit, foreigners will be subject to administrative fines. According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY
An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.
In case of an overstay of less than 10 days, no entry ban will be imposed. Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the Ministry of Interior Directorate General of Migraion Management –Frequently Asked Questions about Foreigners.)
The Length of ban is approximately corresponds to the length of overstayed period. Notification about the entry ban period and the administrative fine is issued at the border gates. In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.
Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4 Law no 6458 on Foreigners and International Protection)
Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

Hello my name is Mehmed, I am bosnian. My problem is that i stayed long term in turkey without visa. i mean without residence permit. soon i am gonna leave the country, so do i have to pay fee, and would i get banned, i stayed 3 and half years without visa here ? if you can help me please.

For overstaying three and half years in Turkey you will need to pay the fine, which might be around 3500 TL. The final decision on the amount will be taken by the customs at the airport. İf you refuse to pay the fine, you will be banned to re-enter Turkey for up to five years.

My permit was when l wanted to renew it and l was told to leave the country in 10days but l couldn’t leave that time because of the business l was doing here ,so know l want go and l was told to pay fine of 1300tl and they will not burn me,my question now is will l be able to come back with a new visa and apply for a new permit.

İf you paid the fine and were not informed about the entry ban at the airport, you can apply for new visa to come back to Turkey. Possibility of applying for new residence permit depends on the type of permit you had before and the city you are going to apply in. İf you were holder of touristic residence permit before, most probably you can not apply for the same type again.

Thank you very much. Also if we leave in september after about 90 days of stay will there be country ban on me and what fees do I have to pay for 90 day overstay?
İf you pay the fine, entry ban should not be imposed. The final decision on the amount of penalty is given by the customs at the airport, you should have around 80$ with you.

Thank you. Its also said that I have to leave the country within 7 days. Is it mandatory or can I still stay for another 30 days in turkey.
Also, can we get an early appointment date for short-term residence permit, is it possible?
İf you would not leave Turkey within 7 days, even if you pay the fine, you might be banned to re-enter country.
İt is not possible to choose the appointment date, it is only automatically given by the system.

Hello,
I have to go to UK on 13th September and my residence permit has expired on 15 June. I had applied for my ikamet on 15th June but today I got to know that I applied for the wrong category i.e. for student permit extension although I had graduated from university on 11th June and should have taken a short-term residence permit. I have Pakistani passport, I don’t know what to do. Now its too late and I don’t know that if I apply for the residence permit appointment it would be very late. So, what should I do? Please reply ASAP

Because of your previous residence permit expired, you will need to pay the fine for overstaying in Turkey at the airport and come back again with new visa to apply again. You will still have a right to apply for residence permit as a graduate in Turkey but there is no guarantee that it would be granted.

Migration refused my application now I’m going back my country Pakistan on 13 Aug.54 days I’m overstay in Turkey..when I will go airport how long before I should go airport ?And where I have to pay fine?same time and same day they can slove my problem?And how much I have to pay?

You should go to the airport at least one hour earlier and directly go to the information point, where you will be instructed about the fine and payment. All of the formalities will be handled at the aiport within short period of time. Final decision on the amount of fine will be taken by the customs at the airport. You should have the amount of around 80$ with you.

Hello pls I am from Ghana and I have giving 15 days visa for turkey but want to stay for 1 month 1 week .will I have a problem of over staying there for another 18 days ?

İf you stay in Turkey longer than your visa allows you to, you must pay the fine for overstaying according to the chart above. Final decision on the amount of fine is taken by the customs at the airport.

I used to have a residence permit from 2006 to 2010 as my father used to work there as a Nato millitary personel. We moved back to our home contry in 2010 and i guess we havent cancelled our gave back our residence premit and now everytime i visit Turkey as a tourist they stop me at the airport for questioning because their system shows that i am still living in Turkey but with an expired permit. Do you know what could be done in this situation?

My recident permit has expired before 3 days, and in 7 days I will go out of Turkey. Can you tell me, if I go out of Turkey when I can come back here? If I stay out for 5 days can I come back and stay 3 months like a tourist?

For overstaying only 10 days you might need to pay a small fine at the airport. İf you pay the fine, there will be no problem to come back to Turkey but you should wait until the period to obtain a new visa passes. This period is dependent on your nationality. For example if your country’s visa policy is 90/180 days, you should not come earlier than after 90 days. Otherwise you will need to sign a document stating that you will apply for residence permit within 10 days upon arrival to Turkey.

I have been residing in Turkey since 2014 as a US citizen, and own my own house. I have been renewing my Ikamet regularly, however this time for some unknown reason everytime I tried to fill up the application to secure an appointment, the system does not allow it. My present residency visa expires next week…I inquired and was told that it could have been caused by the fact that I recently renewed my US passport, therefore I was advised to leave Turkey and return in order to allow the new passport to be lodged in the system, I went to a Greek island and returned the same day. I tried again to complete the application and have not been able to do it. Do you have any suggestion, and can the appointment be made the old fashion way? Kindly advise by convenient return since I am very worried.

This kind of problems are very often connected with application syatem and they can be solved only by immigration office. But as you went abroad and came back, your passport informations should have been updated. İn this case we recommend to go to the immigtaion office in person and explain the details. Appointment can be taken only online, it is not given in the office anymore.
