Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit. |
An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.
ADMINISTRATIVE FINES
In case of overstaying tourist visa (or breaching 90/180 days rule) or exceeding validity period of residence permit, foreigners will be subject to administrative fines. According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY
An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.
In case of an overstay of less than 10 days, no entry ban will be imposed. Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the Ministry of Interior Directorate General of Migraion Management –Frequently Asked Questions about Foreigners.)
The Length of ban is approximately corresponds to the length of overstayed period. Notification about the entry ban period and the administrative fine is issued at the border gates. In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.
Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4 Law no 6458 on Foreigners and International Protection)
Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

What would happen if my residence permit and passport expired would I get deported? And could I take myself to the immigration office in my town to sort my problem out?
Dear Smith,
Thank you for your comment.
According to law, if you do not have valid travel document, you would get deported and banned to re-enter Turkey for up tp five years or until you pay back the deportation costs.
First of all, you should go to the Consulate and try to renew your passport. When you receive it, you can leave Turkey, paying the fine for overstaying at the airport. İf you refuse to pay the fine or for some reason can not pay it, you would be banned to re-enter Turkey for up to five years.
Kind Regards
I explained my situation in the question underneath. Could I still leave the country if I can’t get a new passport

Hi my residen permit expired 7 years ago and my passport 2 years ago. I now want to go back to uk. Will I be able to go and what if they want money and I can’t pay thnx
Dear Linda,
Thank you for your comment.
First of all, you should go to the Consulate and try to renew your passport. Then you can leave Turkey, paying the fine at the airport, which would be around 7000 TL (final decision on the amount is taken by the customs at the airport). İf you can not pay the fine you would be banned to re-enter Turkey for up to 5 years

What if I can’t renew my passport or get a travel document in turkey
Hello, I have heard that black foreigners who have overstayed in Turkey are going to be given a chance to apply for a residence permit in Turkey though with some terms and conditions. These include; pay for the overstay fine, valid passport and with no criminal record. I find this impossible.
Note; me I have one.
Second question;
What does it take for me to get a Turkish citizenship resulting from my residence permit.
What does it take for me to acquire a Turkish passport?
Hello,
Thank you for your comment.
İt is not possible to apply for residence permit after your visa is expired. İf you want to obtain residence permit in Turkey, you need to pay the fine at the airport and after the certain period of time spent abroad, which depends on your nationality, you can apply for new visa so you can make residence permit application based on it.
To obtain Turkish citizenship, it is required to live in Turkey for at least 5 years (or 3 years if you are married to a Turkish national), during which you spent less than 6 months abroad, have no criminal record and also prove that you can speak Turkish at least at basic level. Dear sir/madam,
Last year I overstayed my (90d/180) tourist visa for 35 days (Dutch national). Upon leaving the country, I have paid the fee/penalty. I have not received any verbal or written information about any ban, as far as I know.
Now, I wish to return to Turkey again on a tourist visa in a few weeks. This visit is more than 90 days later from the date I left Turkey last year. I have already obtained a new tourist e-visa. Upon calling various agencies however, I am told two different stories: 1) that upon arrival, border police will make me sign a form declaring I will apply for a residence permit within 10 days, 2) that I will have no problem entering the country.
Can you provide clarity about my situation? Might I be barred from entering? Might I have other problems/things to take into consideration?
best wishes and thank you
Hello,
As you paid the penalty and 90 days since you left Turkey has passed, you should not have problem to enter again. Foreigners who refuse to pay the fine are banned to enter Turkey for a certain period of time, about which they are informed.
Thank you and have a good day
Hi I’ve overstayed my rp and my passport expires soon I’m gonna renew it but if something happens could I still sell my house with a expired passport or if I get deported will turkey take the house of me
Dear Linsey,
İn this case you should leave Turkey as soon as possible before your passport will expire. You will pay the fine at the airport for overstaying your residence permit but there would be no legal consequences as in situation when you get caught in Turkey without valid documents. Then, when you renew your passport, you can apply for new visa and later for residence permit in Turkey with no harm to your property.
Kind Regards
Hi, My residence permit will expire in april, i have applied for aother appoinment and is a few months away, I booked a trıp away month ago not realsıng my RP would have expired. İ have read all ınformatıon and ı wıll have only overstayed 6 days so theır shouldnt be a Fıne ıf so ıt wıll only be a small fıne. Alos ıt says ı can re enter on an E-Visa is this all true?? ı read a comment someone else wrote and you replıed sayıng you recommend they dont leave and you saıd the re-newal applicatıon wıll be cancelled. İ hace never heard or read thıs anywhere. Please help!!!
Dear Melissa,
Thank you for your comment.
If you leave Turkey 6 days after the expiration of your residence permit, you probably will not pay a penalty or it will not be high. However, you will not be able to continue the application for extension of your residence permit and your appointment will be canceled. Also, because of you would exceed the validity period of the permit, another entry using the e-visa may be difficult. That is why we advise you to wait until you get a new residence permit card.
Kind Regards
Can you buy and sell in turkey with a expired passport?
Dear Marilyn,
We can not give you a precise answer because of the lack of details in your question. But we can strongly advice you to renew your passport in order to avoid trouble if you are planning to stay in Turkey.
Kind Regards
Hi I have overstayed my residence permit and now my passport expired 2 years ago. Could I leave turkey on a travel document or would I be stuck here I want to go as I’m really upset
Thanks alot
Dear Kelly,
If you do not have another travel document, we advise you to go to the embassy / consulate of your country to find out if renewal of the passport is possible in this situation. Otherwise, you may have a problem leaving Turkey due to the fact that your residence permit has also expired.
Kind Regards

Dear Jack,
Thank you for your comment.
For overstaying in Turkey for 7 years the penalty should be around 7000TL but final decision on the exact amount is taken by the customs at the airport. İf you can not pay it, you would be deported and banned to re-enter Turkey for five years.
Kind Regards
