Work Permit

Work permt is a permission which is given by Ministry of Labour of Republic of Turkey to foreign employees and companies which would like to employ foreigners. There is four types of work permit as temporary, permanenet, independent and Turquoise cards. The work permit application could be done via https://ecalismaizni.csgb.gov.tr/#/eizin by using electronic signature of employer or by authorized consultancy firm on behalf of the employer. Foreigners cannot obtain work permit on behalf of themself, without employers.

Under contemporary globalization, inevitably labor markets have become increasingly integrated. In order to manage international labor mobility more effectively, especially in those emerging markets and developing countries, new labor migration policies have been established or the existing ones have been re-organized rapidly. At this point, achieving a right balance between the protection of local employment and the relaxation of barriers before high-skilled foreign labor has been the main concern of the state, which led to the introduction of effective tools in the management of international labor mobility.

2003 has been a remarkable year for Turkey to review its rules and principles dealing with the employment of foreign workers in Turkey. As one of the most popular destinations within the global labor market, Turkey has introduced and effectively has reformed a new system to control foreign labor immigration. In the purpose of centralization of work permits system under one code ‘Law no: 4817 on Work Permits of Foreigners’ was originally enacted on 27th February 2003, as the principal legislation in controlling entry of foreign nationals in the Turkish labor market. Subsequently the same year ‘Regulation on the Implementation of the Law on Work Permits for Foreigners’[1] has been introduced to set forth the rules and principles regarding the implementation of the Law on Work Permits of Foreigners. Furthermore, within the context of encouraging foreign direct investments, a new Foreign Direct Investment act was voted and became effective on 5th June 2003. Under the new FDI law, a special treatment is granted to the employment of expatriates with a separate regulation on the employment of expatriates under foreign direct investments. To encourage the employers to seek to employ high skilled foreign workers as well as to prevent informal foreign employment in Turkey, the past few years we have witnessed both systematical and procedural reforms in the Turkish legislation about the foreign labor immigration. Simplification of the eligibility conditions in work permit applications, adaptation of a new automated system for the work permit applications, a shortening in the period of the finalization of the work permit applications and a reduction in the procedural costs of applications might be considered main themes of the reform in the Turkish work permit system. There is no doubt that those further amendments have provided to the Turkish work permit system a more simplified, understandable and dynamic outlook.

The Law on Work Permits of Foreigners provides a legal framework about the employment of foreigners in Turkey by specifying  the rules and the principles to be applied at the procedures concerning work permits of foreigners. The law, in its relevant sections, specifies the types of work permits, outlines the exemptions and restrictions and formulates the rules about granting, extending, rejecting and canceling the working permissions.

The Turkish Ministry of Labor and Social Security is entitled as a competent authority in the work permit process of foreigners. However certain Ministries, Public Institutions and Organizations are also empowered to grant working permissions.  On the basis of their existing authorities arising from relevant Turkish legislation, Prime Ministry,Ministry of National Defense, Ministry of Health, Ministry of Economy , General Directorate of Free Zones and  Council of Higher Education have the competence to grant working permission for specific categories of professions.

As a general rule, individuals who have no citizenship bond with the Republic of Turkey, in order to either work dependently or independently, are obliged to have a valid working permission before they start to work.  Exceptionally, for the working periods no more than one month, in the state of necessity or for the sake of state benefits, by prior notification of relevant authorities and with the ministry approval, working permit may be given after starting to work.

The rules and principles stipulated in the Law on Work Permits of Foreigners are applicable to the foreigners working dependently or independently in Turkey. Those foreigners who receive a job training and the natural and judicial persons that employ foreignersare included within the scope of Law No. 4817 as well. The term “foreigner” in general refers to a person who is not a Turkish citizen under the Turkish Citizenship Law.[1] However those Turkish citizens by birth who got permission to renounce citizenship from the Ministry of Interior are excluded from the scope of Law No. 4817. Moreover, press reporters who are subjected to Press Law, Members of Foreign Press Organs, foreigners who are exempted from working permission requirement in their employment in Turkey due to reciprocity principle, international and European Union laws and foreigners who are employed or granted with working permission by the other Ministries, Public Institutions and Organizations [2] are not included within the scope of the Law on Work Permits of Foreigners.

In accordance with the article 15 of the Law on Work Permits of Foreigners, certain professions are reserved only for Turkish citizens. Different legal instruments in Turkey, prohibit foreigners to work either dependently or independently in  certain professions and occupations. Foreigners are not allowed to work; (i) as attorney[3] (ii)  as notary public[4] (iii) as security guard at private or public institutions[5] (iv) as customs broker and assistant customs broker[6] (v) as dentist, midwife and nurse[7] (vi) as pharmacist[8] (vii) as Veterinarian [9] (vii) as director in private hospitals[10].

Moreover in accordance with Turkish Cabotage Law[11]

“The right to catch or obtain fish, oysters, mussels, sponges, pearls, coral, mother-or-pearl and the like, extract sand, gravel and the like, extract and salvage sunken ships and vessels or shipwrecks and the like either on the surface or on the bottom of the sea, perform diving, searching, piloting and maritime supply, work as captain, secretary, crew or workman or in another capacity on Turkish maritime vessels, and carry out wharf porterage or any type of maritime business, within Turkish continental waters, shall belong exclusively to Turkish nationals.”

Additionally, law no: 6458 on Foreigners and Internal Protection defines the cases in which foreigners may not apply for work permit. Article 27(2) of law no: 6458 states that the following foreigners (who are defined in the article 7 of the law no: 6458) may not apply for work permit.

 “i) it is determined that his or her passport, passport substituting document, visa or residence permit or work permit is absent or fraudulent; or that he or she has obtained these permits fraudulently, ii) he or she does not hold a passport or a passport substitute document which is valid for at least sixty days as of the expiry of visa, visa exemption or residence permit, iii) he or she falls under the scope of the foreigners listed under the first paragraph of Article 15, without prejudice to the second paragraph of Article 15 of this Law, and regardless of whether or not he or she is exempted from a visa.”

  1. Hi, I am an english teacher. I had work permit in Turkey. But I had some problems for renewing it. And I had to apply residence permit, but unfortunately I am rejected and have to go back to my country. I want to apply work permit from my country and also my school will apply from here. But I don’t know what do I need, what kind of documents. I know some of them.
    I need to know what do I need for applying?

    when I apply from my country can I come back directly? After some days ?

    And my last question how long does it take? I mean is it a long process?

    Please answer my questions. I couldn’t find my answers among the comments.

      The school will need to provide you with job agreement and petitions, which you will need to take to Turkish consulate in your home country. You can enter Turkey with work visa, which will be issued by the consulate once your work permit application will be approved. Currently evaluation process takes approximately 30 working days.       There is no restriction regarding age of foreign employee. If you find an employer in Turkey, they can obtain work permit for you. Foreigners can not apply for work permit in their own name or without having a job in Turkey. Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country.

  4. Hello,
    Is that possible to make a new residential permit when your time is finished in Turkey?
    Last year I applied through Aiesec and I got my resident and work permit.
    They informed us for this year that I can applied myself. I got the appointment and went there with my company contract. But they did not give the residential permit in the immigration office.
    And they informed because time is finished I they cannot apply for work permit, otherwise I should get the letter from Aiesec and not the company.
    I do not want to work with Aiesec again, so I wonder if I can apply for a new resident permit and if I am legal till my appointment date is passed already.

    1. Hello,
      It is not possible to apply for residence permit if your previous permit has already expired. In order to submit residence permit application you need to leave Turkey and reenter the country with new visa. Your employer can also directly apply for work permit when you will leave Turkey so you do not need to apply for residence permit. After work permit application would be approved, work visa is issued so you are allowed to enter Turkey and start working on this basis.

        Me and my mother are foreign nationals currently living in Turkey with my brother who has a work permit. We were staying with the Turkish one year resident permit card(tourist status) granted last year because of my brothers work permit. Last week our renewal application was rejected. So now we dont have the resident permit. I wanted to ask some queries.

        1. After the rejection can I reapply for the resident permit or can it be possible to apply for a work permit such as (take care of old lady or a baby).
        2. Secondly if we have to leave, due to pandemic situation the flights are not there to my country. How long can I stay without paying any money fine penalty.
        3. Is there now any way I can reapply and stay in Turkey again without leaving Turkey.

          It is not possible to reapply for residence permit unless you leave Turkey and reenter the country with new visa. Please, be informed that you can not apply for the same type of permit within 6 months upon rejection of your application. Currently touristic residence permit can be obtained for up to one year only once within every two years. If you find a job within Turkey, your future employer can only apply for your work permit after you go to your home country as in order to apply within Turkey you must be residence permit holder. Foreigners do not have to pay fine for overstaying in Turkey under consition that they leave the country within 30 days since the flights to their home country starts.

    I have two questions 1st one is that i am a Pakistani if i obtain turkish Trc then can i apply visit visa of any country from turkey. 2nd question is if i want to start a small business in turkey to get work permit so how much money in dollars minimum i need to start a small business like a shop or food corner etc.

    I have a couple of questions about work-permit and my status in Turkey.

    1. I move to Istanbul in September 2015. So this year, I will be in the country for 5 years. Is this grant me for a new status here in the country? If it does, which are the benefit of it. ( I am originally from an EU country )

    2. I am currently under work-permit status. I am waiting for an offer for a new job, the new company is here in Turkey.
    My question is: Is it possible for the new company to make my new work-permit without the need of me to apply for a new Ikamet and then, the new company will apply for the my new work-permit. If it is possible. What do we/I need to do?

      If you spend five years in Turkey uninterruptedly on basis of work permit, you can be eligible for Turkish citizenship on this basis. During mentioned five years you should not stay out of Turkey for more than 6 months in a row and more than one year in total.
      If you decide to change your job, work permit transfer can be made from one company to another with no need to apply for residence permit.         1. If you would acquire Turkish citizenship on basis of work permit, you would have the same rights as Turkish citizens by birth. You would also not need work permit to reside and work in Turkey as you would be a Turkish ID holder.

      Unfortunately, we can not help you to obtain a visa to Turkey. In order to obtain work visa, first you need to find a job in Turkey and your future employer must apply for your work permit. Foreigners can not apply for work permit in their own name or without having a job in Turkey. Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country and the work visa is issued once the work pemit application is approved.

  8. Hello
    I have applied for tourist residence via rental contract. But all appointments in immigration office are postponed due to covid19. It is now 5 months I’m in Turkey. By the time of my rendezvous it will be more than six months and by the time I get my kimlik card maybe about 8 months.
    Can i apply for work permit now and directly without caring for that residence? Let’s say there is an employer who is ready to employ me.
    And if I get my residence and only 3 months left out of it, will that affect getting a work permit?

      Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. In this case work permit application can be submitted until the last day of resident permit’s validity, remaining duration is not taken under consideration. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country. After the application would be approved, work visa is issued so you can re-enter Turkey on this basis and start working directly after entering the country.

  9. My employer is threatening to cancel my work permit in the next two weeks. I have a residence permit which was issued previous to the work permit and has not yet expired. Would this residence permit still be valid until its expiration date despite cancellation of the work permit?

      Your residence permit was cancelled automatically when your work permit was issued. You can apply for new residence permit within 10 days upon cancellation of your work permit.

    Is there a way to receive a work permit if I work for a foreign company in Turkey and if I receive a salary from the foreign company while in Turkey? I understand that I need a work permit so that I can receive citizenship after living a in Turkey for five years.

      Work permit can be obtained by a company which is either based in Turkey or has a branch in Turkey under condition that the branch meets criteria of Ministry of Labor as minimum 100.000 TL paid capital and 5 Turkish citizens per each foreigner employed in the company.
