The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hi. I have a short term student residence permit that is valid until 28th of June, but I’m flying back home on the 1st of July. What is the procedure or fine to be paid is this case that i need to overstay for these 3 extra days?

  2. Hi!
    I am from American and have been living in Turkey for a little over a year now and I have a RP. My RP expired on May 1, 2019 and I have currently been living the past 4 days on an expired RP. I am moving back to the States on June 15 and don’t want to apply for another RP as I don’t have plans to move back for one year.
    I bought an e-visa online just in case. But I am wondering,
    1. Can I travel INSIDE Turkey with my expired RP? just give my RP, my passport and my e-visa.
    2. Can I travel outside of Turkey within 15 days and pay the fine and then return on my e-visa one or two days later?

      Your stay in Turkey is considered as illegal and you may be deported if you do not leave Turkey and re-enter the country to activate your e-visa. You are also not supposed to travel within Turkey before your visa will be valid.

        1. Am I able to go to a Greek Island and come back the following day and just pay the fine and activate my e-visa? Or is there a certain amount of days that I have to be out of the country?

        I am planning a trip to a Greek Island for this Saturday and that will be exactly 10 days since my PR expired. I will be okay leaving and re-entering?

        1. Dear Raylee,

          As you will overstay your residence permit, you should stay abroad for the period of time, which is equal with visa regulation for your type of passport (mostly 90 days if you entered Turkey on 90/180 days visa). Otherwise while re-entering the country, you might be asked to sign the document stating that you will apply for residence permit within 10 days upon your arrival to Turkey.

    I overstayed my student visa in 2015 (by about 29 days) and was unable to pay the fine when leaving Turkey. Does this mean that I cannot reenter Turkey until 2020? Will I still have to pay a fine when I go back to Turkey?

      If you were banned to re-enter Turkey, officers should have informed you about duration of entry ban while leaving Turkey. You should contact Turkish Embassy/Consulate if you are not sure about your status. You will not need to pay the fine during your next visit in Turkey.

  5. Good morning I have 2 questions.
    Firstly : I’m coming to Turkey with one month sportsman Visa .
    Am I eligible to apply for Residence permit?

    Secondly: if I eventually get residence permit and I want to go back how long should I stay outside turkey before coming back again

      If you can provide Immigration Office with documents confirming your admission into sports fedaration or club within Turkey, you are eligible for residence permit application. You can leave Turkey and come back with no need to obtain new visa as long as your residence permit will be valid. After expiration of your residence permit, you should stay abroad for a period of time depending on visa regulations for your nationality.

  6. hello, I’m a student here in turkey and planning to go to middle east next week and my student permit it will be expired 5 months and 23 days before I will come back to turkey. I asking this question because some of my friends told me that I need to come back to turkey 6 months before the expiration date of my RP.

      There is no restrictions regarding leaving or entering Turkey before the expiration date of your residence permit. You can enter the country as long as your permit is valid, even if just one day is left.

  7. My work permit was cancelled İn December 2018. I was not in Turkey at that time and my employee did not inform me the actually date it was cancelled.
    I applied for residence permit with all the necessary documents needed. After two months the application was cancelled with the reason i failed to apply with 10days after it was cancelled. Do i have the right to appeal. ı think its unfair, i work legally, pay tax, no criminal records and even have credit card debts to pay.
    i need help concerning this matter and if they reject my petition. Will be ask to pay a fine at the airport or will be ban.

      It is highly possible that you made a conditional entry to Turkey and you were supposed to apply for residence permit within 10 days upon arrival. You will need to pay a fine at the airport while leaving Turkey and if you will, it is unlikely that you would be banned to re-enter the country. However, final decision on the fine will be taken by customs at the airport.

  8. i have to go back to my home for the summer and my RP expires on 1 sept while um coming back on 5 september .Will it be a big problem,will i have to pay a fine

  9. Hi
    I overstayed on my e-visa by about 30days and paid a fine at the border when leaving turkey. The police said nothing about conditions of re-entry or if I’d been banned from returning to turkey. If I want to return soon can I just buy another e-visa?

      If you would be banned to re-enter Turkey, officers at the boarder must inform you about this fact. As you paid the fine and did not receive any notice regarding entry ban, there should be no problem to re-enter the country.

  10. Hello, I am an erasmus student from romania at Marmara University, and I have some problems applying for resident permit.
    My 90 days ends on 05 of may 2019, but I have to stay in Turkey untill the end of June. Do you think that if I cross the border for a couples of hours to BG or GR, those 90days are gonna be renewed? Otherwise, what should I expect as worst case scenario?

      If you leave Turkey and re-enter the country before another 90 days pass, most probably you will make conditional entry and will be obliged to apply for residence permit within 10 days upon arrival. If you would not fulfill this condition, your stay in Turkey would be considered as overstaying your visa. You will then have to pay the fine while leaving the country.
