The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hi! Thank you so much for the information you’re providing, you’re the first website that I’ve read that actually clarifies this situation!

    My question is, my tourist visa ends on the 12th of April, but I’m only leaving on the 18th of May (already bought a ticket back to Portugal, since I’m Portuguese). My mother is coming to visit from the 10th to the 18th of May, and we were hoping to spend 2 days in Cappadocia. My problem is, since my stay will already be illegal by that time, do you think that is possible to take a domestic flight showing only my Portuguese ID card, without them noticing at the airport that I am overstaying my stay in Turkey, or is it too risky?

      It will be required to show your passport at the airport and if the fact that you are staying in Turkey illegaly would be noticed, most probably you would get deported and might be banned to re-enter Turkey for up to 5 years.

Hi, My wife has a recidence permit and is expiered on 20th of March, and we have to stay one more month due to my job, is it possible to go out from Turkey Thru Cesme via Ferry to a greek island, and come back with E-Visa ? we have planned to go out on the 22nd, so it will be just 2 days of overstay.

      If you leave Turkey after residence permit expiration date and come back earlier than visa regulations for your nationality allows you to (for most countries it is 90 days), most probably your wife would be asked on the boarder to sign a document stating that she will apply for residence permit within 10 days upon arrival. If the application would not be lodged within this period of time and finalized, your wife’s stay in Turkey would be considered as overstaying. In this case she would need to pay the fine while leaving the country and might be banned to re-enter Turkey for up to 5 years.

  3. My girlfriend over stayed her tourist visa by over 15 days at the very least. She messaged me yesterday that she was being taken to a station for her expired visa and has no replied to me back yet. Is she being deported? she doesnt have means to leave the country otherwise, and is an american citizen. what happened to her? what do i do?

      If your girlfriend was caught without valid visa, there is possibility that she is being deported. If you are within Turkey, you can call 157. If not, you should contact the Turkish Embassy.

  4. Hi my daughter and granddaughter came from UK to visit August 2018 after death of father on an evisa and have overstayed. They intend leaving in June 2019. İn UK they will be homeless as her sister and myself live here and are re married to TC. She has been offered work if she wishes to return which would mean my granddaughter aged ten can go to school here too. She will be alone in UK, a single parent that has no contact with her expertise the father of my granddaughter. I’d like her to remain here. She obviously faces a fine for overstay, any ideas how much and could she apply for a work visa from UK to return and re-enter. Does she face a ban from returning. Help and advice appreciated.

      Your daughter and granddaughter should pay a fine for overstaying while leaving Turkey. If no entry ban would be implied, they can come back to Turkey after obtaining new visa and then apply for residence permit or application for work permit can be done by the employer before your daughter’s arrival to Turkey.     If I overstayed with an expired residence permit but managed to re-enter Turkey with e visa, is it possible to apply for a new residence permit?

      After you re-entered Turkey with new visa, you are allowed to apply for residence permit. However, if you entered Turkey conditionally and signed a document stating that you will apply for residence permit within 10 days upon arrival, you are only allowed to apply before mentioned 10 days pass.

    I have one additional question. I happened to have a dual citizenship. Will I be able to enter Turkey, this time with my other passport with no problems?
    I haven’t traveled anywhere on the other passport so I should be practically able to start over as a citizen of different county with no previous record, is that correct?

      Even if you would manage to enter Turkey with another passport, it would not be legal to use another document in order to avoid consequences of overstaying in Turkey.

  9. Hello, I’m from the USA. I didn’t realize that I was supposed to stay only 90 days within the duration of my e-visa which was 180 days. It was an honest misunderstanding on my part. Upon leaving Turkey I was surprised when the customs wanted me to pay a fee for overstaying. However, I paid it on the spot and considered it solved. When I returned back to Turkey 5 days later on a new 180 days e-visa I was let in, but I didn’t notice the fine print on the accept form saying that I’m permitted to entry Turkey if I fulfill the condition of applying for residence permit within 10 days which I missed and was not aware of. And now I also realized it’s counted from the day of departure, not according to e-visa duration. So, I have another two problems (Not applying for residence permit on time and overstaying for the second time – because just now I found out ). It’s been all just unfortunate circumstance that I didn’t realize. I’m really afraid now of the consequences and appreciate any advise you can give me. Thank you very much.

      Unfortunately, as you overstayed the limit of ten days, you can not apply for residence permit anymore. You are supposed to leave Turkey as soon as possible and pay the fine again. However, for second overstaying the entry ban can be implied. The final decision on the consequences will be taken by the customs at the airport.

    I have a question ,my RP(rezidence permit)expires on marh3/2019,i allready applied for a new one 11.02.2019,i want to travel to my home (Romania),but my flight is on 08.03.2019,so this RP will expire and the new one takes 90 days .
    Can i leave turkey and come back after 15 days ?
    What do i have to do /pay?
    i went today to the residence permit office and they could not issue a paper to leave because the papers where not yet in the system.my old papers are there .
    Can you please help me with this ?

    i went to take this document that allows me to leave 15 days but i am not in the system yet and i am leaving on 8.03.2019 and my old residence expires 03.03.2019,can i leave ,i have to pay a fine?i can came back with a visa or something?
