The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    I have a question ,my RP(rezidence permit)expires on marh3/2019,i allready applied for a new one 11.02.2019,i want to travel to my home (Romania),but my flight is on 08.03.2019,so this RP will expire and the new one takes 90 days .
    Can i leave turkey and come back after 15 days ?
    What do i have to do /pay?
    i went today to the rezidence permit office and they could not issue a paper to leave because the papers where not yet in the system.my old papers are there .
    Can you please help me with this ?

      You can ask for the document allowing you to leave Turkey for up to 15 days after the appointment when your new data will be in the system.

    Thanks for helping all the expat concerns so promptly.

    I work in turkey on work permit, One of my friend is a traveller blogger, he arrived Turkey in May 2018 by tourist visa for 30days and he applied for RP but appointment was in mid july 2018, all the procedures was successfully completed including paying resident fee but after 1-1.5 months. The online status was changed as “please visit immigration office blah blah” when we visited Immigration office in fatih göç idaresi randevu they stated that his tourist visa was expired just after applying for RP and he should leave county to follow the same procedure to apply RP card and also the tax money or fee paid was not refunded

    therefore he started overstaying and continue to go around turkey as travel blogging now it’s almost 9 months and if he overstay for 1.5 year or 2 year and exit Turkey by paying requested penalty. can he travel back to turkey after 6 months cooling period ?

    Looking forward for your response on penalty for 1.5 or 2 years and can travel back after 6months?

      Amount of the fine depends on your friend’s nationality. You can check the approximate amounts in the chart above. Please, be informed that the final decision on the fine will be taken by the customs at the airport and it might differ from the official amounts. If your friend pays a fine for overstaying while leaving the country and entry ban would not be implied, he can come back to Turkey after 6 months.

      Addition to the comment, his nationality is Indian and other one is Chinese
      a) What could be the Approx total fine for these nationalities for overstay of 1.5 year and 2 year?

      b) Overstay fine is as per latest policy from Turkey Immigration?

      c) If fine is paid while exit, can they return to turkey after 6 months cooling period?

      Please clarify!.

  3. hello , i renewed my residence permit in 3 January and i left turkey 2 weeks after even before receiving my ID card , and i have been out of Turkey for more than weeks now . can i go back to turkey without the residence permit card ? And how can i know if the new card is issued even though my turkish number which i gave to the immigration office is not working ?

      You will need a new visa to enter Turkey again. However, if your residence permit was issued while you were abroad and you have not picked up residence permit card on time, it might be cancelled by now. After arrival to Turkey you should contact Immigration Office, where you applied for residence permit.

  4. Hello,
    I left turkey 4 days after my residence permit expired, which was the 7th of February 2019
    I was told that if i leave the country and then come back the normal free 90 days of stay will start again. it it true ? cause I need to come back to turkey for 2 more weeks

      You can come back to Turkey after obtaining new visa. However, be informed that if 3 months since your RP expiration date would not pass before your next entrance to Turkey, on the boarder you might be asked to sign a document stating that you will apply for residence permit within 10 days upon arrival.

  5. Hi there. Thank you for helping people with giving them advice in regards to their overstayed visa in turkey. I experienced this myself as well. I went to turkey in March 2018 to visit my family through E-Visa which is only for 30 days. However, I ended up staying for 2 months. When I was leaving turkey, I did pay the fines and the officer told me that if I come back to turkey within one year, I can only stay for 15 days. I will be going back to turkey in March (which is before completing that one year in order to stay more than 15 days) and planning to stay for 45 days this time. Would you please tell me what would happen this time. Also, I am going to Ankara and I have a connecting flight in Istanbul, would they stamp entry on my passport in Istanbul or in Ankara, and vice versa. Thank you for your help in advance.

      If you would overstay in Turkey again, you might be banned to re-enter the country for up to 5 years. If you are planning to stay longer than your visa allows you to, you are supposed to apply for residence permit in Turkey. However, be informed that the application can last up to 2 months and you are not supposed to leave Turkey before procedures would be completed.

    4 years ago I visited Turkey for 3 days. I was living in Germany (legally, with residence permit)back them. When I was leting Turkey back to Germany Turkish passport control took me to another room. I was the only Brazilian in the flight and I was the only one took to the immigration chief. He asked me if I had other nationality, which I said “no”, later he asked me to wait, typed many things on computer, looked all the pages of my passport, many times, than stamp my exit. He didn´t said or asked anything
    This year I am planning go to Turkey again but I don´t know if I should worry or try to figure out if they put anything against me. I didn´t overstayed nor did anything wrong.

      The officer should have informed you if there would be an entry ban implied on you so there should be no problem to visit Turkey again. However, if you are not sure if you are allowed to enter the country, you should first contact local Turkish Embassy/Consulate.

  7. So the case is this I have Schengen visa valid from 27 january,2019 and turkey e-visa valid from 18 january,2019. So in this case can i fly tomorrow for turkey on 25?

    as schengen visa shall be used as supporting document for e-visa and there is difference in dates. Please reply asap. Please.

      As Schengen visa is a supporting document to enter Turkey, it should be valid on the day of arrival. However, you should contact Turkish Consulate/Embassy in your homecountry for details in your case.

  8. I overstay 4 days. When i was leaving turkey i didnt have money to pay. Then the police say i cant back to turkey in five years. Would be possible get some borderland and try to pay the penalty??
    Do you know if they would let me enter?
    And if i apply for a visa would be necessary to pay the penalty?

      If you were banned to re-enter Turkey, it is not very likely that the ban would be removed. However, as you overstayed only for 4 days, you can contact the Turkish Embassy/Consulate in your home country to get more detailed information about possible solutions.

  9. Thanks for your response. Do you happen to know what kind of ban could result, as in time frame. For example, I was expecting just a three month ban (normal for tourist visas) but learned a few days ago it is six months. The next time increment will be one year. Do you know at what point it switches from 3-6-12 months?

    I would like to know if there is a difference in consequences between overstaying from an expired tourist visa/ikamet and an application denial which orders you out in ten days?
    I was told by several officers it wouldn’t matter how long as long as I was prepared to pay the penalty.

      Fees after denial of application are calculated in the same way as if you would overstay a visa in Turkey, what means that you are supposed to pay the fine for the amount of days between your visa expiration date and leaving Turkey.
