The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hiya there, I’m a US citizen that has overstayed my e-visa for 5 months. When arriving at the airport, where must I proceed to head to in order to pay the fine?
    Also, how much of a fine must I pay? After I pay the fine, am I permitted to re-enter Turkey after a few months?

      According to official fee amounts, you should pay around 90 USD. Please, be informed that the final decision on the amount will be taken by the customs at the airport and it can differ from the official one. After arrival to the airport you should directly go to the information desk so you will receive directions regarding payment. If you pay the fine there should be no reason to imply an entry ban so you can come back to Turkey after 3 months passes.

  2. Hello, I’m an Italian student. I lived in Turkey for three years with a regular residence permit. I came back to Italy some weeks ago, before the expiration date of the residence permit. My residence permit expired on the 31st of December. Next week I have to go to Turkey again for one week to take my diploma. Italians can enter to Turkey as tourists without visa and they can stay for maximum 90 days. Do you know if I can enter as a tourist even if I had a residence permit that expired some days ago?       You are supposed to wait for 90 days after expiration of your residence permit in order to enter Turkey again. If you come back earlier, you might be asked at the entrance to sign a document stating that you will apply for residence permit within one week upon arrival.

  3. Hello I am from Malawi, I graduated from university and have overstayed my residence permit by about 90 days? What will be the fine and what would be the consequences of being unable to afford the fine.

      For overstaying in Turkey 90 days, you should pay the fine in amount of around 70 USD. Please, be informed that the final decision on the fine will be taken by the customs at the airport and can differ from the official fees. If for any reason you would refuse to pay the fine, you will be banned to re-enter Turkey for up to five years.

Hello, ım from Poland and I overstayed in Turkey over 60 days, my turist visa expired on15th of November,i apply for resident permition on 11th of November,my randevu tarihi was on 21st of December, then when all my documents was check up came up that I overstayed in Turkey, head of emigration office told that I need go out from country pay penalty for overstaying then back in same day bring document I payed penalty and apply for new resident permit. I’m planing my life in Turkey and I’m afraid that when I go out from country i ll be not able to return. So my question is if all what was told to me is right and how much aprocimatly penalty I can pay on border. Best regards

      For overstaying 60 days in Turkey, your penalty should be around 60 USD. Please, be informed that the final decision on the amount of fine will be taken by the customs at the airport and can differ from the official fees. If you refuse to pay the fine, you might be banned to re-enter Turkey for up to five years. If you pay the fine, you can come back and re-apply for residence permit.

    I have got a tourist visa on FEB 2014 then I renew it for the second year and on FEB 2016 when i have to renew it for 3rd year my my kids paspoet was unvalid and time i couldnt renew them from our Syrian consulate in ISTANBUL but after 3 month I succesded to get a new passports the i went to immigration office in Alany where im staying to renew the tourist visa for me and my tow kids .. they say that im late more than 3 month for due time of renw’ng … and we are now overstaing in turkey since FEB 2016 and we have to go out of turkety and come again to apply a new visa – i told them that I am syrian and we have war in our country and ‘f we went out of turkey we cant come back since the turkish goverment stoped to accept giving entrance visa for syrian … i tried tow time afterthat to argue them to change our statues without going outside turkey but unfortunatly they didnt accept … i came tired from this situtiaon i need to get a new residence visa and apply for work permision since i am Architect …im under hypertension and i want to find a way to to legalize my situation .. plz advise me what to do and to go …thanks in advance ..my best regards

  7. I have applied for a residence permit for the first time for myself and my 2 kids and 82 days passed now already and no answer neither any feedback yet till now on the three applications. I called 157 and got the same answer I read online that the application is under assessment. and I am hitting the max limit 90 days in a week time. What are your recommendation for this case please?

        I came to turkey on the 11th January 2021 on a tourist visa valid for 15 days and it got expired on the 25th of January 2021….
        However I have overstayed for about 4months and i would like to know how much I have to pay when I leave turkey

  8. Thank you for the reply. It really helped. I was told that I can leave Turkey within ten days after expiration of my Residence Permit but since I already applied for renewal, I did not leave as I became legal.

    My question is, I have not gotten the refusal letter yet, which is Tabligu Bilgesi. Will my ten days period start the minute I collect it from the Immigration department. That means I can leave the country within ten days after I collect the Bilegsi.

  9. Hello. My Turkish Residence Permit expired on Oct 16, 2018 and i applied for the renewal the same day. They asked me to send the documents via PTT and I did that. Then Today (Dec 11) I went there to check if my card was arrived, they said my application has been rejected because I did not send the missing documents within 30 days. They sent me a text apparently but since it was in Turkish, I did not realise it was from the Ministry of Turkey. Now I want to re-apply but they are saying I need to leave the country and then come back and apply. I dont have a problem leaving the country and paying the penalty. My only concern is, since my visa expired on Oct 16. its been almost 2 months that I have overstayed. Although i did not know because I had applied for the renewal. My question is, If I come back, what can I do to make sure they let me enter the country because if they put a ban, I will miss all my classes at my Academy. Your response would be appreciated.       If you pay the fine for overstaying and explain the situation, most probably no ban would be implied. However, when you leave and come back, you might be asked to sign a document stating that you will apply for residence permit within 10 days upon arrival. If you would not manage to apply within this short period of time, your application will be rejected.
