The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. hi, I got 2weeks visa to turkey and they gave me 7 days to send out of 2weeks but I have already booked 10 for my stay in hotel and flight (i did not realise am going to only 7days). what should i do, because am not running out of visa before I leave the country? am going to be fine or ban.

      If you were granted 7 days visa, any day spent in Turkey after this periof of time is considered as overstaying. If you overstay in Turkey, probably you would need to pay the fine but entry ban should not be imposed for such a short period of time if it is your first overstay and you pay the fine. Please, be informed that the final decision on consequences of overstaying in Turkey will be taken by the customs at the airport.

  2. Hello – My wife is from Moldova and was deported from Turkey in 2011 for a 10 day overstay on a 30 day visitor visa – she did not have money to pay the fine at the time. We think she was banned from re-entry for 5 years.

    We now want return to turkey to set up a company and trying to understand if her 5 year ban has been automatically removed (it has now been 7 years since original ban) or if we need to get an approval from the local Turkish consulate before travelling

    P.S. We know that Moldovan’s now have visa free travel to Turkey since 2016

  3. I’m from somalia been students for about 3 years then cancelled my university. I applied tourism visa they gave me 5 months the second time the also gave me 5 months. I have applied again but this time they gave me only one month RP For me to prepare to leave Turkey, But i can’t leave this country now because I’m not ready and for some social reasons i don’t want to go back to my backwarded country. I’m going to overstay Turkey for years or i was thinking to apply humanitarian resident permit. Will there be risk of deportation if happens for me to apply humaniterian resident permit or claim assylum here?

      If you would be stopped for control in Turkey and you would not have valid documents that allow you to stay here legally, you would be deported and banned to re-enter the country for up to 5 years. If the application for another type of permit or assylum in Turkey would be denied, you also must leave the country immediately. The best solution for you is to you find a job in Turkey, then you can go back to your country for the period of work permit application, which takes around one month. When the application would be accepted, you will receive work visa to come back to Turkey and after arrival you will be also given work permit, which would be your residence permit at the same time and you could stay in Turkey legally as long as you are employed here.

  4. Hello! I am from Brazil. I will need to overstay in turkey for 81 days. How much will I pay? Do I pay this fine at the airport before embarking?
    How long will I have to wait until be able to return to Turkey?

      For 81 days amount of your fine should be around 70 USD. Please, be informed that the amount of fine can differ and the final decision will be taken by the customs at the airport, where you will also pay the fine. If you would refose to pay the penalty, you might be banned to re-enter Turkey for up to 5 years. Otherwise you can come back to Turkey with new visa after 90 days.

  5. Hi I’m a 18 years old British female my passport as residence permit expired 3 years ago as I couldn’t afford to renew them. I really want to return home to England. I don’t care if I can’t come back what should I do to leave? Thanks

      For three years of overstaying without valid documents you will need to pay the fine of around 3000 TL while leaving the country. You would be also most probably benned to re-enter Turkey for up to five years.

Thanks for the information; but i have a problem I overstay 15 days when i leave Turkey a police take too a small room and told me might ban my enter for 5 years but after check only told me I’ll have to pay some feed when I try to come back turkey or if I want pay in the embassy and get Visa the problem is I don’t remember how much I have to pay and the did not gimme any document.
    I’m Salvadorian passport I don’t need visa to enter

      You were supposed to pay the fine at the airport, before leaving Turkey. Otherwise, you were most probably banned to enter the country for up to 5 years. In this case officers should also inform you about the exact period of time you are banned for. If you are not sure if the ban was imposed and for how long, you should contact Turkish Consulate/Embassy in your country.

  7. I want to know if is it possible to enter Turkey again after I exeeded the period of visa ( iam going to apply for another work permit from tunisia), even i am banned from entering turkey for one year????

      If you are banned to re-enter Turkey, it is illegal to employ you and apply for your work permit until the period of time that you were banned for will pass.

  8. How much would one pay if one has overstayed for 7 months in turkey?

      Amount of fine depends on foreigner’s nationality. For citizens of most countries this fine, according to official rates, should be 110$. Be informed that the final decision on the fine would be taken by the customs at the airport and can differ from official fees.

      You can not renew your expired residence permit, without leaving Turkey. You should go abroad to obtain new visa and apply for new residence permit after entering Turkey again.
