Residence Permit

The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

  1. Hello!

Thank you for all the info in this website, is really helpful!
I have a question regarding the resident permit. I stayed in turkey for 110 days, paid the fine and left. Im coming back next week for a month and a week. As I am brazilian and I don’t need an e-visa Im quite sure they would make me sign the paper with the condition of applying the residence permit in 10 days period. The question is, this appointments for visa are taking much more than one month now that Turkey is having a busy time with immigrants. What could happen when I leave the country again only with the appointment for the permit? Thanks

    1. Hello,
      Thank you for your comment.

If you leave Turkey before finishing the application procedures and receiving residence permit card, you will be banned to re-enter Turkey for up to 5 years.

  2. My partner applied for ikamet renewal 24/10/18 and had appoinment 26/10/18 was informed she has overstayed we have Tickets back to Norway 6/12/18 and return 29/12/18. Do we need to go back to Norway before and Then return with a evisa or can we stay until desember and pay fine at AirPort and will There be a ban on entering Turkey?

    1. Hello,
      Thank you for your comment.

As your partner has already overstayed in Turkey, she will need to pay the fine while leaving Turkey and is supposed to come back not earlier than after 90 days. It is the same either your partner decides to leave Turkey now or in December. If she pays the fine and would not be banned to re-enter Turkey, your partner can come earlier than after 90 days but in this case she would be asked to sign a document at the airport which states that she will apply for residence permit within 10 days upon arrival. She must then apply and finish the application procedures, otherwise she would be banned to re-enter Turkey for 5 years.

  3. hello,

i have a friend that overstayed at turkey, how much is the penalty for 8 months staying in turkey, thank you

    1. Hello,

Fees should be calculated according to the chart, depending on foreigners nationality. The final decision on the exact amout will be taken by the customs at the airport.

      Kind regards

  4. hello, my wife just payed 600 L for overstaying. can she come back to turkey in next week ?? no one informed us about any ban.

    1. Dear Houssem,
      Thank you for your comment.

If your wife paid the fine and there was no information about being banned to re-enter Turkey, there should be no problem to come back next week. Most probably in this case on the boarder your wife will be asked to sign a document stating that she will apply for residence permit within 10 days upon arrival to Turkey.

      Kind Regards,

According to official fees, fine for 6 months might be up to 144$, which is equivalent of almost 900TL. Please, be informed that the final decision on the amount will be taken by the customs at the airport and might differ form the official charges.

  6. Hello,

I have double transit visa with 3 days duration. Does it mean i can only stay 3 days each visit? what if i need to stay 5 days? would it affect my next visa process or any other country visa. I am Pakistan national by the way. need your kind suggestion regards

    1. Hello,
      Thank you for your comment.

If you stay longer than 3 days during your visit, it will be considered as overstaying. As a cosequence you will need to pay a fine and you might be banned to re-enter Turkey for up to 5 years. Overstaying might affect future visa applications.

  7. Hi, thank you so much for you Quik answer, my girl Freund came to Turkey on 14th of Mai, and we will leave turkey on the 28th of October, so she will over stay in total 74days, as we are allowed to stay in Turkey 90days .
Did you mean with 5§ a day or the month? 😮
Thank you so much for your cooperation.

  8. Hello,
As i‘m Working in Turkey as a TUI rep, I have my work permit my own appart , my girlfreind came to visit me as she’s Tunisian she diden‘t need a vis for Turkey , but she can only stay 90 days for the next 180 days; but now she’s here in Turkey over 74days overstay, please can you advice me, or tell me how much we have to pay when we leave the country , and if she’s Band to visit Turkey again in short theme. Thanks in advacnce . Sinserly regards,

    1. Hello,
      Thank you for your comment.

It is difficult to tell how much you will need to pay as yoou did not mention when you are going to leave Turkey. Officially maximum fee for Tunisian citizens is maximum of 5$ for first month and 0,5$ per remaining months. Be informed that amount might differ from official fees. The final decision on the amount is taken by the customs at the airport.

      Kind regards

  9. Hello,

I entered Turkey on 26.07.2018 with a multiple entry internship visa that is valid until march 2019. I left the country on 24.08.2018 for a vacation and came back on 02/09. I will be staying in Turkey until 07.11.2018 and I don’t really have time to apply for a residence permit. If I don’t count the days spent abroad (which should be the case right?), I will be overstaying for 13 days. Paying the fine is no problem but is there a possibility of getting a ban to enter Turkey in this case?

    1. Hello,
      Thank you for your comment.

As you said, only days spent in Turkey count as days when you used your visa. If you did not overstay in Turkey before and will pay the fine, there should be no reason to imply an entry ban on you.

      Best Regards

  10. Dear ExpatGuide!
I was leaving Turkey on a tourist visa 16 days late of my allowed 90-day stay (as I was confused because I also changed my passport in the meantime). That means how I was in the country for 106 days and I paid the fine.
I have scheduled a meeting with the residence permit office on 15th of October, for which I need to come back. Am I allowed to enter the country?
My current visa is valid until 21st of November and I am of Croatian nationality.

    1. Hello,
      Thank you for your comment.

You need to be already in Turkey in order to apply for residence permit. If you applied while abroad or left Turkey before the appointment and after your visa expired, your application would not be accepted. You should apply again after you will come to Turkey on new visa.
