The consequences of overstaying in Turkey

Update : 03.09.2015 Overstaying in Turkey might occur in three possible ways; A foreign national, might overstay a visa; or might breach the 90 in 180 days rule during his/her stay in Turkey, or might continue to stay in Turkey without renewing his/her residence permit after its expiry period.

90 in any 180 Days Rule In compliance with the Decision of the Council of Ministers dated 10.10.2011, No: 2011/2306, starting from 01 February 2012, total duration of stay of foreigners who visit Turkey as tourists cannot exceed 90 days in any 180 days period. Foreigners, who are intending to stay in Turkey longer than mentioned period (90 days in 180 days period), are required to apply for residence permit.

An overstayer, in all mentioned circumstances, will be subject to administrative fine and as well as might be barred to re-enter Turkey lawfully for a fixed term.

ADMINISTRATIVE FINES

In case of overstaying tourist visa (or breaching 90/180 days rule)  or exceeding validity period of residence permit, foreigners will be subject to administrative fines.   According to Law on Duties no: 492 section 6, failing to apply for residence permit or failing to renew the existing one, does not prevent collection of the fees for overstayed period. Administrative fine may vary according to the nationality of the foreigner. This fee is calculated on the basis of double amount of existing permit fee charges. In addition to the permit fees, if applicable, administrative fine may include residence permit card fee  and single entry visa fee.  (For details permit fees page.)

RE – ENTRY BAN FOR OVERSTAYING IN TURKEY

An entry ban is imposed to the foreign nationals who are staying in Turkey illegally when they don’t have valid visa or a valid residence permit.

In case of an overstay of less than 10 days, no entry ban will be imposed.  Moreover “entry ban order will not be issued against the foreigners who exceed the duration of visa, visa exemption or residence permit for more than ten days and arrive at the border gates to exit before a removal decision is taken against them. However, the foreigners who violate the mentioned durations of visa, visa exemption, work permit or residence permit will pay a fine.” (For more information you may consult to the  Ministry of Interior Directorate General  of Migraion Management –Frequently Asked Questions about Foreigners.)

The Length of ban is approximately corresponds to the length of overstayed period.  Notification about the entry ban period and the administrative fine is issued at the border gates.  In case of failing to pay imposed administrative fine, a foreign national might be barred to enter Turkey for five years period.

Maximum duration of an entry ban to Turkey is five years. “The entry ban to Turkey for foreigners whose visa or residence permit has expired and who has applied to the governorates to exit from Turkey before their situation is established by the competent authorities upon which a removal decision has been taken, shall not exceed one year.” (Art.9/4  Law no 6458 on Foreigners and International Protection)

Entry ban might be lifted in case the overstayed person applies to the Turkish missions abroad for the relevant type of visa. Applications are forwarded to the Turkish Ministry of Interior for approval and the visa can be issued upon the affirmative instructions of the Ministry.

    I’m from Afghanistan with USA Green Card (Permanent resident ). They give me one month VISA since i have Afghan passport. I would like to Stay for another month. Do you know how much will i have to pay for the fine. And do i get banned from reentry. or any other consequences at the airport. Any input will be greatly appreciated it. Thank you

      Fine for one month overstay should not be higher than 50$. Final decision on the exact amount would be taken by the customs at the airport. If you pay the fine there is no reason for any other consequences like entry ban.

    I unfortunatly recieved a 5 year-ban from entering Turkey, since i was in a hurry when leaving the country and had misunderstood some of the procedures.
    I got this ban lifted, and can now enter Turkey, but i was told i have to pay the fine when i re-enter the country. Since i was in a hurry, i didn’t get the information about the amount of the fine, do you know where i can find this information? Who to contact? I am a danish national citizen, and i got the fine at Sabiha Gokcen airport.

  3. If after being rejected for a residence permit and given 10 days to leave, can you leave on the 10th day itself and not get further penalties or does it have to be the day before
    Example: Signed notice of removal on sept 6 and leaving on sept 16th

    Also one other important question
    If I came on April 1st. Applied in April for resident permit And waited till September to get an answer ( and leaving the country in September ) can I come back on October 1st? ( 180 days since april 1st ) and satisfy the 90/180 rule?

    1. You need to leave Turkey within 10 days, including the 10th day.
      İf you pay the fine while leaving Turkey and would not be banned to re-enter the country, you can come back on a new visa after 90 days. Otherwise, if you come back earlier, you will be asked at the boarder to sign a document stating that you will apply for residence permit within 10 days upon arrival. İf you do not apply during this period or fail to finish application procedures, you will have to leave the country and will be banned to re-renter Turkey for up to 5 years.

  4. Hey there. Can the border agents tell who is a dual citizen. Regarding the 90/180 rule. Can a dual citizen leave for a week and come back with a different passport and visa and will be allowed in ?

      As you already crossed Turkish boarder before, your data is in the system so your identity is possible to be checked easily while entering the country again. We would strongly recommend obeying the 90/180 rule instead or applying for residence/work permit if you need to spend more time in Turkey.

    One of my friend overstayed in Turkey around 2 years and while he leaves from Turkey he got banned for 5 years because he didn’t have money to pay.
    Now he wants to pay the fine and lift the ban? Can you please advise how to proceed or is this possible? Thanks in advance.

    I have been in Turkey for almost 90 days and I should leave tomorrow to not exceed the permitted time (I have a Swiss passport). I am having some issues with my visa for Iran though, and need to wait for it at Trabzon consulate. Could you tell me what happens if I stay around 10-15 days longer in Turkey? And also, I will leave the country by bus, will I have to pay my fine at the boarder? Is it something that takes long time? (I wouldn’t want the bus to not wait for me!).       You will need to pay a small fine at the boarder for overstaying. İf you pay the fine there should not be any other consequences like ban to re-renter Turkey. You can pay the fine at the boarder, it would not be a long procedure.

        1. Maximum fee for overstaying up to one month is 50 USD so we would recommend to have at least equivalent of this amount in USD, EUR or TL with you while leaving Turkey. The final decision on the amount will be taken by the customs at the boarder.

          1. So, what happened is that I overstayed 4 days (entered Turkey the 10th of June, left the 11th of September). At the border they have asked me to pay a fine of 660 TL, more than 90 USD, I didn’t have the money and even if, I wouldn’t have paid such a way to high fine for such a short overstay (caused by the delay in answering from the Iranian consulate in Trabzon by the way… and knowing that some people have paid 50 USD by overstaying 6 months). Refusing payment, I have been deported from Turkey for 5 years. Maybe the information you have regarding fines need update, rules might have changed, they insisted that it is the system (computer) that gives information about how high the fine must be.     I have visa type A2 with spanish passport for tourist propose, I came to Turkey on 6 th of july and at now, I discover that my visa will be expired tomorrow, because itwas 90 days (and not 180 days). This visa is valid until 30 th November (multiple entry) what i have to do? should i go to Greece and come back? can i extended online? can i apply for residence if my visa is expired? HELP PLEASE

      You can apply for residence permit as long as your visa is valid. Otherwise, when your visa expires, you should leave Turkey and can come after another 90 days with new touristic visa. İf you come earlier than after 90 days, you will sign a document at the boarder stating that you will apply for residence permit within 10 days upon arrival.

  8. my girlfriend was in Cyprus for only 25 days and was on her way home they stopped her for overstay visa and now wants 2876.00 as a fine or they will send her back to Cyprus to be jailed. is this true can they do that

Hello I would like to know that I had resident permit which expired in beginning of July 2018 and now I hve overstayed for almost 2 months and hold a US passport and planning on leaving turkey so where do I pay my fine and how much wud it cost me and do I hve to pay in Turkish lira or in US Dollars.       You can pay the fine at the airport. For this purpose you should arrive there around 30 minuts to one hour earlier than planned. For 2 months your fine might be around 60 USD but remember that the final decision on the amount of fine is taken by the customs at the airport. Fine can be paid in both – Turkish Lira or US Dollars.

  10. Hi Sir, I visited turkey some time ago while my stay there I applied for residence permit they gave me 4 month time for my hearing (appointment). On hearing they refused me residence permit so came back to Pakistan on rejection. I also paid fine for my over stay in turkey at airport. Can I apply for visa now? Is there any ban or restriction on me to apply for turkey visa??
