Can Foreigners who are Illegal in Turkey Purchase Real Estate?

Firstly, it should be known that foreigners can buy real estate in Turkey even if they are illegal in Turkey, provided that they comply with legal restrictions. In other words, foreigners do not need to have a residence permit in Turkey to purchase real estate. According to Article 35 of the Land Registry Law numbered 2644; “On the condition that legal restrictions are complied with, foreign national real persons, who are citizens of the countries determined by the President of the Republic of Turkey, may acquire real estate and limited same rights in Turkey, when required in terms of international bilateral relations and the interests of the country. The total area of ​​immovables acquired by real persons of foreign nationality and limited independent and permanent rights in rem cannot exceed 10% of the district area subject to private property and thirty hectares per capita throughout the country.

Foreigners who want to buy real estate in Turkey are required to have prior knowledge at some points. We can list these points as follows:

– The General Directorate of Land Registry and Cadastre should be asked which country’s citizens can buy real estate in Turkey.

– It is necessary to make sure that the real estate to be purchased is not within the borders of the military security zone. If the real estate is within the borders of the security zone, real estate sales to foreigners cannot be made.

However, after the legal conditions are fully met, foreigners can buy real estate in Turkey regardless of their residence permit. Again, it is necessary to make an appointment in advance for the deed transfer process. Foreigners can make online appointments for this transaction through the Land Registry Appointment System of the General Directorate of Land Registry and Cadastre.
