New Arrangement! Who Will Pay the Shipping Fee?

The new development, which concerns consumers, was announced in the Official Gazette. With the new regulation, a regulation was made about the withdrawal of technological products such as mobile phones and computers.

The new regulation, published in the Official Gazette on August 23, included a decision that concerns many consumers. “Regulation on Amending the Regulation on Distance Contracts” was shared by the Ministry of Commerce. However, there are regulations regarding the shipping fee and the right of withdrawal for the return of the products.

CONSUMER WILL PAY THE CARGO FEE

However, consumers will now pay for the return shipping costs themselves. The right of withdrawal cannot be exercised on technological products such as mobile phones, smart watches, tablets, computers and drones purchased. The consumer will now pay the return shipping fee.

ARTICLE 11- The phrase “four” and the following paragraph have been added to the same article to come after the phrase “ten” in the first paragraph of Article 13 of the same Regulation.

“(3) The consumer is obliged to cover the return cost, not exceeding the delivery costs, if it is agreed in the preliminary information and the amount is included in the return with the carrier stipulated by the seller. However, if the goods delivered to the consumer are defective within the scope of Article 8 of the Law, the consumer cannot be held responsible for the costs of returning. If the consumer requests, the return cost can be deducted from the cost of the goods or services to be returned to him and the delivery costs.

ARTICLE 13- The following paragraphs have been added to the first paragraph of Article 15 of the same Regulation.

“ı) Contracts regarding movables, which are required to be registered in accordance with the Highway Traffic Law No. 2918 and dated 13/10/1983, and unmanned aerial vehicles that are required to be registered or registered.

i) Contracts regarding mobile phones, smart watches, tablets and computers delivered to the consumer.

j) Contracts concluded through auction in the form of live auction.

k) Contracts regarding the installation or assembly of the goods specified in the introduction and user manual by the seller or authorized service.

Consumers will no longer be able to benefit from the right of withdrawal in contracts concluded through unmanned aerial vehicles, mobile phones, smart watches, tablets, computers and live auction auctions, which require registration and registration. However, if there is a problem with the products, there will be no obstacle to the return of these products.

RETURN DAY EXTENDED TO 14 DAYS

The time limit for shipping the return has been increased to 14 days. In case of a refund, the card limits will be refunded at once: In case of product payment by credit card, card providers will now be obliged to add the amount transferred by the seller, supplier or intermediary service provider to the cardholder’s usable limit in one go, upon receipt. The regulation on credit cards will come into effect on January 1, 2023. Other regulations will be in effect from 1 October 2022.
