The perfume bottle designed by Eda Taspinar for Yildiz Shop was sued. The company won the lawsuit it filed against Selim Yesil, alleging that it secretly registered the bottle design in its own name.
According to the lawsuit filed at the Istanbul Intellectual and Industrial Rights Law Court; Yıldız Shop Cosmetic Marketing and Industry Company was the owner of the bottle designed for the Eda Taspinar brand. The bottle that is the subject of the lawsuit was designed by Taspinar. Yildiz Shop presented this design to the public for the first time.
Allegedly, Selim Yesil applied to another court and claimed that the bottle design belonged to him. Yildiz Shop’s lawyer, who learned that the design was secretly registered with this lawsuit, said, “Selim Yeşil has acted to harm the commercial life of the client company.”
COURT JUSTIFIED
Lawyer Makbule Özer said, “Selim Yesil has secretly usurped the subject design. This design was designed by Eda Taspinar for the ‘Eda Taspinar’ brand. All rights of the design belong to Yildiz Shop. For this reason, we want Selim Yesil’s trademark to be declared null and void.” The court, which found the request justified and accepted the case, decided to invalidate the design registered in the name of Selim Yesil, considering that it was not new and distinctive.
