Residence Permit

Rights conferred by long term residence permit

In some web pages and forums, it is seen that there is a misunderstanding about the article 44 of the Law on Foreigners and International Protection. Article 44 of the Law regulates the rights conferred by a Long-Term residence Permit.

Some of well known Expat web pages and forums, at this point, argue that Foreigners will also have rights and obligations which are only granted to the Turkish citizens such as military service, participation in national elections, employment in public services and etc.  However article 44 reads that foreigners who have Long Term Residence Permit shallbenefit from the same rights as accorded to Turkish citizens, EXCEPT

a) Compulsory military service,

b) The right to elect and be elected,

c) Employment in public institutions,

d) Exemption from taxes in importing vehicles

PLEASE FIND BELOW THE READING OF ARTICLE 44.

“Rights conferred by a long term residence permit

(1) Save for acquired rights with regard to social security and subject to provisions in related law as regards the use of these rights, foreigners who have been granted a long term residence permit shall benefit from the same rights as accorded to Turkish citizens with the exception of provisions in special legislation as well as the rights regarding:

a) Compulsory military service,

b) The right to elect and be elected,

c) Employment in public institutions,

d) Exemption from taxes in importing vehicles.

(2) The Council of Ministers shall be authorized to place restrictions on the rights set forth in paragraph 1, partially or in its entirety”

  1. Hi I am an American married to a Turkish lady for 16 years and had the resident permit for the last 12 years I’m retired and live in Turkey my wife tried to renew online but it would not accept the numbers how can I renew or extend my current resident permit for another four or five years and how much would it cost for your company to process thank you

    1. Hello,
      Thank you for your comment.

You can extend your residence permit as long as it is still valid. After expiration of your current residence permit you need to go abroad in order to obtain visa to Turkey to be able to apply for a new one. Currently residence permit is given for maximum 3 years, not for 5 as it was before. Our company would be glad to assist you throughout the whole application process. The cost of our services is 900TL + VAT.

      Kind Regards

  3. Hello,

Please how long can I stay to be qualified for the permanent residence permit or/and Turkish citizenship, if there is any option like that?

    1. Hi,

      Thank you for your comment.

The eligibility requirements for Turkish citizenship are fairly straightforward: You need to be of adult age (according to your country of origin), and you must have lived in Turkey for at least 5 years, with a total interruption of less than six months. This is reduced to 3 years if you are married to a Turkish citizen or if you are a foreigner born on Turkish soil.

      Kind Regards

    2. Can I apply for tourist visa 1 year? Any restrictions now for 1 year residence permit for Americans?

      Thank you for your comment.

You can buy e-visa online. It is enough to print a PDF later, which you will receive by e-mail after paying the fee. You will find the link to the page below. https: //www.evisa.gov.tr/en/

You can apply for a tourist visa if you rent a flat in Turkey and meet other conditions. Please read the information on our website.

      1. No, the evisa is not available for Americans at this time.

I asked if I can get a visa at the airport upon arrival . . . it is not clear about this for Americans.

I will be flying in from Dubai.

        1. Dear Mr. Daniel,

Unfortunately, there is no such possibility. If you enter without a visa, you will be exposed to problems.
