Regulation on the implementation of law no 6458 on law on foreigners and international protection

PART II – SECTION II – RESIDENCE PERMIT

Regulation on the implementation of the law numbered 6458 has been published on 17 March 2016 at Official Journal numbered 29656. Implementation regulation actually reflects the provisions of Law No. 6458, but also identifies and clarifies many points in the implementation of Law on Foreigners and International Protection. In regard to residence permits, most important implications and clarifications of the regulation have been in the defining deadlines formally and clarifying rules regarding residence permit application process and residence permit application document. In the regulation, in line with the Law on Foreigners and International Protection, following points are elaborated in more details.

Residence Permit Application Document   Foreigners, except those who’s stated on their application forms that they are exempted from fee, without waiting the result of their residence permit application, by presenting residence permit fee receipts and within the residence permit duration they requested, will be able to leave Turkey more than once and on their each travels if they return to the country within fifteen (15) days they will be exempted from visa conditions. As per article 21 (9) of the Regulation

  1. what is the signification of low no 6458 article 15-1b please is that means a entry ban? and how longs of the duration of the ban pls

  2. Hi there, I have a couple of enqueries about TRC:
    1. Can we work in Turkey after getting TRC? Like, in order to manage living expenses while staying as tourist resident?
    2. Can we search for jobs and apply for work permit during our stay on TRC?
    3. Once a student completes 2 years of education in Turkey, for how long he can stay in Turkey legally?

    1. Hello,
      Foreigners are not allowed to work in Turkey as a residence permit holders. In order to work in Turkey your future employer must apply for your work permit. Foreigners can not apply for work permit in their own name or without having a job in Turkey. Application for foreigner who has residence permit valid in total for at least 6 months can be done within Turkey. For foreigners who are not residence permit holders, application must be done via Turkish Consulate in their home country. After graduation foreign students can apply for one year residence permit.

  3. Hello,
    My husband has been banned to enter Turkey by law 6854 1-b. He was coming back from Jiddah and had handed over this ban paper and sent back to Jiddah at the same day.
    1. Why he was not allowed to visit Turkish embassy in Turkey while he was in Turkey airport?
    2. What are the reasons covered under this ban no 1-b actually? It’s completely unknown and it’s again return travel to Jiddah.
    My husband never committed any crime, he traveled to Saudia Arabia for umrah purpose through Turkey,but while coming back he found out that he was banned to enter Turkey.and now he’s again flying to Jiddah.
    Please support us to clarify what is the reason.

      Your husband should contact the nearest Turkish Embassy/Consulate in order to receive informations about reason of the entry ban.

  4. i went to Istanbul last year on 27.08.2018 and i have been refused entry under law No. 6458 Article 15-1(b). I dont know for what reason actually and the officer there also did not tell me anything. They just took my passport and deport me back to my country. Can someone tell me how long this ban will last and how do i lift this ban? i never committed any crimes anywhere and i am holding original passport. I really love Turkey but unfortunately you banned me from there.

    Please help me, i want to go there again next week.

      As you do not know when and for how long you have been banned to re-enter Turkey, you should contact nearest Turkish Embassy to receive information about your current status.

    2. Same situation !! I never traveled there before or overstayed. So I don’t understand the entry ban. I want to know if we get banned and deported , will they stamp the passport saying I m banned or not ??

        If you would be banned to re-enter Turkey, you will receive an official notice stating the period of entry ban.

        1. The letter says “Your entry into Turkey has been refused by the 7 of the Law no. 6458 due to entry ban [Law no. 6458 Article 15-1(b)].”
          But it does not state for how long is the ban . And they did not stamp anything on my passport either. So how do I find out ?

  5. I got evisa for 30days but I overstayed 1 more day in Turkey and I have already be fined by custom, so I am wondering will it influence next time I travel Turkey

  6. A Syrian friend of mine came to Turkey without documentation. The Turkish authorities provided him with a ‘temporary protected person’ ID which was recently renewed. He also acquired a Syrian passport from the Syrian consulate in İstanbul.

    If my friend wishes to obtain a Turkish residence permit (ikamet) will the fact that the passport doesn’t contain any entry stamps stand in the way of him getting residency? If yes, how can this be remedied?

  7. Hi there…
    I hope you can help me…
    I am swiss citizen..i applied for a short term residency permit which got rejected. When i left turkey i payed the fine for overstaying. It is now about 6 weeks that i am in switzerland but i would like to go back to turkey now. Can i reenter or am i banned for 3 month..i dont know what to belive some tought me im only allowed to came back after 3 months some say i can reenter and apply again within 10 days.
    And if so..if i apply for the new permit am i only allowed to leave the country 15days at the time???

      Thank you for your comment.

      You need to stay abroad for 3 months in order to obtain new visa and come to Turkey again. If you come back earlier than after 3 months, you will be asked at the boarder to sign a document stating that you would apply for residence permit within 10 days upon arrival to Turkey. If you decide to come earlier and apply for residence permit, you should not leave the country until you finish application procedures and receive your residence permit card. Otherwise your application would be cancelled and you would be banned to re-enter Turkey for up to five years.

          When you arrive to Turkey with new visa after 3 months, you can leave Turkey and come back as long as your visa will be valid. After your visa expires, you should wait for your residence permit card to leave Turkey. For some cities 15 days rule does not work anymore. You should ask the officer at the appointment about possibility of receiving permission to leave Turkey for 15 days period before receiving residence permit card. If you apply for residence permit shortly after arrival, it is possible that you would finish application procedures before your visa expires. This way you would avoid any period of time during which you are not supposed to leave Turkey.

  9. Hi, I have a Greek residence when I enter the Turkish territory through Sabiha airport. They prevent me from entering, knowing I have entered Turkey twice before. And they returned me to Greece, after a two-hour inquiry without knowing the reason for the Turkish authorities and the Greek authorities? They gave me a book to take to the Turkish embassy

      Article 15 of the law no 6458 on law on foreigners and international protection explaines the rules regarding foreigners whose visa applications should be refused. Paragraph 1-g says: Visa shall be refused for those foreigners who do not possess sufficient and sustainable resources[for the duration of their stay]. If This explanation does not give you any idea about what the reason could be, you should contact the local Turkish embassy as we do not know enough details of the situation to provide you with exact reason in your case.

  10. I have been told conflicting information, which is hard to confirm if it is correct or not. My question concerns foreigner residence application/extensions for Istanbul.
    Foreigner will now need to have their name on a lease for the length of intended short term residence. It is no longer sufficient to have a notary letter stating when you reside with a Turkish citizen.
    Foreigner will need police report from home country
    Foreigner will need medical report about blood
    Foreigner will need to show at least a 6 month bank statement showing sufcent funds (USD $500 per moth minimum)
    Foreigner must show tourism plans or reason for requiring a short term residence permit
    only once will short term residence be permitted for 1 year only maximum.

    Can any/all of this be confirmed?
